iPhone user sues Apple over Siri voice assistant

“A New York man represented by Robbins Geller is suing Apple for false advertising, alleging that the company’s commercials convey a ‘misleading and deceptive message’ about Siri’s capabilities,” Joe Palazzolo reports for The Wall Street Journal.

“Frank M. Fazio, who bought his 4S in Brooklyn in November, is part of purported class of people who feel suckered,” Palazzolo reports. “Fazio claims Siri is far less responsive in real life. When he asked for directions to a certain place, or to locate a store, ‘Siri either did not understand what Plaintiff was asking, or, after a very long wait time, responded with the wrong answer.’ (Disclosure: We own an iPhone 4S, and Siri has been generally responsive to our requests for directions. Even in Midtown traffic.)”

Palazzolo reports, “The lawsuit, which asks for unspecified damages, says Siri is ‘at best, a work-in-progress.'”

MacDailyNews Take: It’s a beta, you moron. Siri beta. Your ambulance chasers should know better. Plus, Siri doesn’t speak Babbling Idiotish. Apple should send a message by countersuing for whatever legal expenses this episode of morbid stupidity causes them to incur plus damages.

  1. I’m quite sure Apple does not want anyone who is not completely satisfied with an iPhone to return it for a full credit if they are not completely satisfied. How can you sue Apple that you are dissatisfied with a product with this policy in place? It seems clear that Apple intended the “beta” to cover any other offer to perform a service that their advertising for a personal assistant might have implied. Maybe there is some “grey” area where this guy can claim harm and a large bucket of cash from Apple. Clearly, this guy thinks he has purchased a lottery ticket instead of a smart phone. Defense of suits like this clearly make the cost of products higher and brilliant innovations like Siri almost non existent. Dr Lazio needs to get a life and stop interfering with ours. The iPhone 4S lives up to Apple’s credo to build insanely great products. No other voice recognition in the history of humanity has ever come close to this product, even after 10’s of billions of dollars have been spent on R&D. Even if you had spent $200 for your Siri product alone in its current state, it would be a relative bargain considering the cost to develop this product.

  2. As a Canadian I wish that Siri had been positioned as a limited function voice dictation service. While none of the commercials shown in the US were aired on Canadian channels I did feel a bit duped when Siri can’t find locations outside the US. To this day it still can’t. I stopped using Siri and will use Google search until Siri comes out of Beta. Still I agree suing is a childish response. Is he saying with Siri the iPhone 4s isn’t worth what he paid for it? The camera improvement alone was worth it for me.

  3. Beta or not I don’t use Siri at all due to a combination of not liking to have people hear what I’m doing on my phone (not Apple’s issue admittedly) and it not working consistently enough. I often have to repeat myself, or correct commands, so ultimately it’s mostly quicker to do it by hand. It’s good but not good enough.

    I can see that doing so much advertising for a beta product might leave them open to people being unhappy with it, but a lawsuit is just stupid. Either return it, or try before you buy.

  4. Let the scumbag lawyers and whining, entitlement-drunk liberals continue ruining this country one lawsuit at a time! Po’ t’ings must be suffering so from Siri falling below expectations while the rest of us (self-reliants) cheer how fantastic it is! Stock Hint: invest heavily in adult diapers cuz it’s going to go thru the roof if this keeps up!
