“A federal judge on Monday ended a sales ban on the Samsung Galaxy 10.1,” Ina Fried reports for AllThingsD.
“Judge Lucy Koh had issued the injunction in June based on the likelihood that a jury would find that a specific Apple design patent had been infringed,” Fried reports. “Although the jury largely sided with Apple in the case and awarded more than $1 billion in damages, the jury didn’t find Samsung’s tablet infringed on that particular product.”
Fried reports, “Koh could still impose a permanent sales ban on that and other Samsung products after a hearing in December… For the time being, Koh is also hanging on to a $2.6 million bond that Apple had posted, but will decide later whether any of that money should be given to Samsung on the basis that the injunction was wrongfully issued.”

MacDailyNews Take: December? Why not just wait until January, so Samsung can have the entire Christmas shopping season to sell their patent infringing plastic junk to the unsuspecting and the criminally obtuse?
Right on, MDN! Lawyers r the scourge of humanity!
Shut up moron. The court has specific time frames it has to follow to permit both sides to file motions, responses, etc. It also has a busy docket and to schedule hearings for something likely to take as long as the Apple v. Samsung case has shown needs more than an hour or two.
Bizlaw, I agree with iMaki. ‘Right on, MDN! Lawyers r the scourge of humanity!’
If all the dishonest lawyers were put out of business the unemployment rate would jump by 3%.
JeanPool will have his head up his Lawyers ass the day the IRS comes calling or for any other mater that will require his or her services. Last I checked Apple has Lawyers too.
I thought the jury had given the SGT a pass because the design had been “registered”, which was a mistake as registering a design does not make it immune to trade dress infringement, or something along those lines.
Judge Koh couldn’t bear hurt a Korean company. I guess crime pays.
What a load of Samdung.
is she qualified to be US federal judge or Korean judge?
And even with the injunction lifted, they will sell… NONE.
Whaaaa, whaaaa, whaaaa. It’s not fair. Whaaa, whaaa, whaaa.
Great legal argument there, Apple fandroids/fanbois. Time for Apple to man up and appeal.
Fucking REDICULOUS. Samsung plastic shit tab will be obsolete by then.
