Samsung to file injunction against Apple for iPhone 4S in Paris and Milan

“Samsung Electronics announced plans Wednesday to file preliminary injunction motions in Paris and Milan, Italy, to block the sale of Apple’s iPhone 4S there,” CNN reports.

“Samsung is accusing Apple of two patent infringement, both dealing with wireless telecommunications technology,” CNN reports. “It did not rule out filing preliminary injunctions in other countries as well.”

CNN reports, “The latest accusation Wednesday deal with the Wideband Code Division Multiple Access (WCDMA) standards for 3G mobile handsets. ‘Apple has continued to flagrantly violate our intellectual property rights and free ride on our technology, and we will steadfastly protect our intellectual property,’ Samsung said in a statement.”

  1. This is worrisome , it just takes Samsung one win to stop Apple iPhone sales.
    Samsung is a huge company and is a major player on many fronts .
    Apple is very much dependent on it’s mobile drive and solid integration with iPad, AppleTV and Macs .

    Apple needs to win all the time , samsung just needs one to start the ball rolling .

    1. Even if Samsung bribes its way into a temporary injunction, people will simply buy iPhones in other European countries. No worries at all. Samsung won’t win, anyway. The company does not have a lock on 3G wireless.

      1. Actually, that what stopped sales for the Iphone from booming, due to lack of local sales.
        take a look at the sales in china Before and after local retailers are allowed to sell iphones.
        The difference is HUGE.

        Apple need to win this.
        Samsung, Nokia,LG and other major mobile players had a tacit understanding not to sue one another but to share patent.
        Then it all depends on design and use.

        Apple needs to win this…i love my IPHONE and WILL DEFINITELY not want another crappy Nokia or android phone…

    2. These are patents that are covered by FRAND. Samsung is committing the internationally illegal act by not licensing them to Apple with the same terms they are licensing them to other companies. Apple is not submitting to Samsung’s extortion.

      Learn about FRAND as it relate to patents that are essential to industry standards.

  2. The absolute worst case on this issue is that Apple must pay a “fair and reasonable” licensing fee to Samsung. Very likely that is already covered in the software/firmware cores (or ASIC cores) in the chips Apple uses for the waveform generation for 3G. If the IP is really required for any 3G phone then Samsung MUST license it to any and all comers as part of the standard. Additionally, Samsung cannot say to the rest of the Android pack that the fee is X dollars per phone and the fee for Apple is 100 times X per phone. The licnensing fees must be proportional and fair.

    Samsung is just filing these for notoriety. They already know these rules exist. All the judges presiding over these know it too.

  3. All the useless attacks on Apple are purely dog and pony shows intended to distract both Apple and the buying public, they assume everyone in the world is as stupid as the politics of today and will bite.

    Fortunately were talking about substance and quality products, unrivaled for everything about them – The Future is Now, everyone wants an iPhone and an iPad because they are the only products worth using and buying.

    Apple rules today’s tech and it’s not about who “says” it ain’t so, it’s about who cares and produces superior products that never die.
