Beleaguered Dell engaged in repeated misleading, deceptive and unlawful business conduct, judge says

“Dell Inc. deceived customers in a massive ‘bait and switch’ scheme to increase sales of its computer and electronic products, a New York state judge ruled Tuesday,” Karina Frayter reports for CNN.

“State Attorney General Andrew Cuomo sued Dell in 2007 on behalf of hundreds of customers who claimed that the electronics company lured them into buying products with promises of attractive deals and promotions,” Frayter reports. “In reality, the lawsuit alleged, most customers were denied or misled into believing that they had been approved for low interest or financing rates.”

Frayter reports, “In a 26-page decision, Supreme Court Justice Joseph C. Teresi found in favor of the consumers. ‘Dell has engaged in repeated misleading, deceptive and unlawful business conduct, including false and deceptive advertising of financing promotions and the terms of warranties, fraudulent, misleading and deceptive practices in credit financing and failure to provide warranty service and rebates,’ Teresi said in his decision.”

Frayter reports, “The court will hold further proceedings to determine how much restitution Dell will have to pay its customers.”

    Um, you added the bucket!

But those lonely server room guys have a saying, “ANY port in the storm.”

  2. @ the infamous Zuney Baby

“I need to enjoy the turkey club mom packed in my lunch”
    That right there says alot.

“Maybe I’ll charge my Zune in there too, that is, if the IT guys will let me”
Charging your Zune in the middle of the day. That also say alot.

“There’s a new Subway in the food court where at the mall. I know because there used to be a Dell kiosk next to the food court”
That says it all. “Used to be”

  3. ZT’s aim in life is to maintain his repetitiveness and to see how many of you will reply to his usual artificial PC/MS love-in crap. Cripes do you guys laugh at the same joke that you’ve heard a thousand times?

@Spark…I cannot believe ZT= C1. She has standards.

  4. ZuneTang …. you once again said things that explain the problem.

    1) A DELL Kiosk ….. KIOSK!! Dell sells its PC’s via Kiosks in a mall ! that explains a lot.

    2) You said it used to be there …… as they did so much bad business they couldnt even keep a KIOSK running…

and if my IT guys take food into the computer room .. heads would roll.

  5. Dell has been doing this for year! People always bitch about how “expensive” Macs are cause there’s only one price while with Dell you get a bottom barrel price then you have to pay for it to actually be useful. In the end you’re paying much more than the bait price. I’m glad they finally got caught!

  6. Oh my gosh, apparently a few people do not realize that our friend Zune Tang uses MAC on purpose and as part of his/her incredibly cynical shtick. Much like the Colbert Report. Ease up folks, Mark Twain they may not be but still funny.

  7. Sorry Sparky.

I’ve hardly had any time to even check in. And while I do admire Zune Tang™’s tenacity, I can take no credit for the quality of their prose. Though maybe I should… would that flush him out?! What if I appeared on Oprah, agonizing to her about my breathless love of Microsoft products and my dismay at the existence of style and taste. Sharing my secret fear of simple, intuitive interfaces and refined industrial design. I bet that would really piss ZT off. Hmm…

    Suck that dork, Max!

  8. @Zune Tang

Great stuff! Here’s for separating the apples from the oranges (or is it lemons?). Or, as the saying goes, never attribute to malice that which can be adequately explained by stupidity. Now I’m off to collect my ordered IPA’s and american saisons. Cheers! (completely OT, but WTF ” width=”19″ height=”19″ alt=”grin” style=”border:0;” /> ).
