Apple, Burst.com settle patent dispute for $10 million

Burst.com’s press release verbatim:

Burst.com, Inc., today announced today that it has signed an agreement in principle to settle its case against Apple, Inc. ending almost 2 years of litigation. Apple agreed to pay Burst a one-time payment of $10 million cash in exchange for a non-exclusive license to Burst’s patent portfolio, not including one issued U.S. patent and 3 pending U.S. patent applications related to new DVR technology. Burst agreed not to sue Apple for any future infringement of the DVR patent and any patents that might issue from the pending DVR-related applications.

The $10 million patent license provides Apple with the right to use Burst’s intellectual property in its own technology and products, without further consideration. Burst, however, retains the right to enforce its patent portfolio against others.

Burst plans to continue identifying and evaluating companies who represent licensing opportunities and intends to diligently pursue those likely to yield suitable returns. Burst does not plan to announce specific names of suspected infringing products or companies in advance of negotiating with them or filing litigation to enforce its patent rights. Burst does not plan to publicly release any internal assessments of market segment size or dollar value of those markets, although it believes that they are significant enough to warrant the aggressive pursuit of patent licensing.

Court costs, expenses and attorney’s fees in connection with the settlement of the litigation with Apple will reduce proceeds to the Company to approximately $4.6 million. According to the agreement, payment to Burst is to be made promptly after signing of a definitive settlement agreement. Burst’s Board of Directors has indicated that it will be considering a cash distribution to Burst’s shareholders from the Apple license fee, in an amount to be determined.

The company will not be further publicly addressing issues or answering questions regarding subjects that the Company’s Board of Directors has not yet adequately addressed or resolved, or regarding subject matter that the company’s legal counsel has advised is either privileged in nature, or should not be discussed for strategic or other reasons. As the Board and management make further determinations regarding the matters discussed in this Release and other matters involving the Company’s future operations, the Company may, at its discretion, make further announcements to all shareholders and will also post those announcements on the Company’s web site.

  1. It seems to me that we British did something good, We gave land we owned (spoils of war remember) back to the original displaced people who owned that land since biblical times. From what I read in this thread that land was mainly wasteland and wasn’t really used by anyone for anything. Over time their neighbours decided they wanted that land for themselves which has since been reclaimed and made useful so they start wars against the people who now live there. And those people naturally defended themselves. The British didn’t encourage them to attack. We were not puppet masters. They did it all by themselves. They are grown men. They made their own decision to start a conflict.

    Now in the logic of some anti-British on this board the whole resulting conflict can be re-written to make it all our fault. How about a little blame on the rich Americans who have been known to help fund Israel’s part in the conflict.

    Stop with your hate mongering guys. It’s pathetic. Get over it. It’s not like America hasn’t cocked up anything in it’s history.

    How about showing a little respect for the young British soldiers who are dying in Iraq and Afghanistan every week to help support the American war on terror? Your huge beef with us Brits over ancient history (which is probably inaccurate anyway) is an insult to their lives, and if their girlfriends, wives, parents and children could hear you rattling on about how much you blame us Brits for everything after the losses and heartache they’ve endured I am sure they would be as disgusted as I am.

    FFS, this is a site about Apple and Macs, iPods, iPhones etc. It’s bad enough having Windows trolls on here without bigots as well.

    And for the record. I have no real issues with Americans unless you consider the way gangster rap has influenced gang culture (and gun love) in many British teenagers. Thanks for that!!!

    As for me, I have many American friends and my daughter is in a relationship with a talented young American who I really like because he makes her happy. So don’t think I am being Anti-American. I’m not. I just think a tiny handful of people on here need to be a little less aggressive to my nation.

  2. Actually, Thanksgiving is a perfect analogy of today’s issues. The turkey gets carved up, like the world, and some end up with the breast, some the leg, some the gizzard. In any case, we should be thankful for what we get. Now, let’s all find that wishbone and wish for world peace. And please pass the gravy!

    Oh, and I don’t really give a sh*t about thanksgiving as a ‘holiday’ for any reason. It’s become a marketing exercise for Macy’s and all the other Malls up and down this messed up country.

    Yes, I agree, now that we’re winning the war in Iraq, it’s a perfect time to bring the troops home. Nothing like snatching defeat from the jaws of victory there Huey.

  6. There is no “victory” to be had – what a hollow statement that is. We shouldn’t have been there [Iraq] in the first place, Bb. So yeah, let’s bring the troops home. After all we’ve managed to kill tens and tens of thousands of Iraqis with ‘smart bombs’ or simple gunshots, added to another 3,000+ US citizens to go with the more than 25,000 psychologically and physically maimed Americans that’re back here needing support right now!

    So yeah, keep that support our troops sticker on the back of your Hummer, but just put your money where your mouth is and support all those maimed and psychologically destroyed soldiers arriving back in our towns on a daily basis.

    Sounding off about “victory” on a Mac users website makes you sound even more shallow and vacuous that you obviously are.

    As well as Saudis, Syrians, Afghans, Pakistanis, Iranians, Egyptians, and other folks known as “the enemy”. You do realize that we are in Iraq SPECIFICALLY to kill the enemy don’t you Huey? In fact, if we had killed more of the enemy before now, we would probably be done with the job by now.

    Those citizens signed up to defend this country. It is a sad reality of war that men are lost on the battlefield. Nevertheless, the VAST majority of our military wants to stay in Iraq and finish the job they started. They consider any other option to be traitorous, You wanting them to come home is probably because you know that this will result in a failed Bush policy. That is just sick.

    Meanwhile, our fighting men and women wish liberal America-haters such as yourself would STFU. It would make their job easier and get them home sooner.

    A better idea would be for you put a sticker on the back of your earth-killing Prius that says:

    BTW Huey, “maimed and psychologically destroyed soldiers” come back from every war. That is the price our military men and women have agreed to pay in order to allow dimbulbs such as yourself to express as much ingratitude and anti-America hatred as you so choose.

    I am not the one who ended a juvinile post with “bring the troops home now” on a “Mac site”. AQ and the Iranian insurgents just LOVE guys like you. BTW, there is nothing more “shallow and vacuous” as your bumper sticker mentality; imagining that bringing the troops home now, just as we are achieving victory, is the very epitome of “shallow”.

    If you long for the rusty Islamist knife on the back of your neck, Huey, that is your right. As for the rest of us, we will continue to root for the inevitable victory in Iraq.
