Amazon won’t be forced to restore web service to Parler after a federal judge ruled Thursday against a plea to reinstate the fast-growing social network.

U.S. District Judge Barbara Rothstein in Seattle said she wasn’t dismissing Parler’s “substantive underlying claims” against Amazon, but said it had fallen short in demonstrating the need for an injunction forcing it back online.

Amazon kicked Parler off its web-hosting service on Jan. 11… The Seattle tech giant said Parler had shown an “unwillingness and inability” to remove a slew of dangerous posts that called for the rape, torture and assassination of politicians, tech executives and many others.

Parler CEO John Matze asserted in a court filing that Parler’s abrupt shutdown was motivated at least partly by “a desire to deny President Trump a platform on any large social-media service.” Amazon denied its move to pull the plug on Parler had anything to do with political animus. It claimed that Parler had breached its business agreement “by hosting content advocating violence and failing to timely take that content down.”

Parler was formed in May 2018, according to Nevada business records, with what co-founder Rebekah Mercer, a prominent Trump backer and conservative donor, later described as the goal of creating “a neutral platform for free speech” away from “the tyranny and hubris of our tech overlords.” Amazon said the company signed up for its cloud computing services about a month later, thereby agreeing to its rules against dangerous content.

Parler has stayed online by maintaining its internet registration through Epik, a U.S. company owned by libertarian businessman Rob Monster.

MacDailyNews Note: Parler will still be able to pursue its lawsuit alleging that Amazon Web Services’ cutoff of hosting was “a politically motivated decision to favor Twitter,” Joel Rosenblatt reports for Bloomberg News.

          The Antrim County Clerk and Secretary of State Jocelyn Benson have stated that the election night error (detailed above by the vote “flip” from Trump to Biden, was the result of human error caused by the failure to update the Mancelona Township tabulator prior to election night for a down ballot race. We disagree and conclude that the vote flip occurred because of machine error built into the voting software designed to create error.

          Secretary of State Jocelyn Benson’s statement on November 6, 2020 that “[t]the correct results always were and continue to be reflected on the tabulator totals tape…” was false.

          The allowable election error rate established by the Federal Election Commission guidelines is of 1 in 250,000 ballots (.0008%). We observed an error rate of 68.05%. This demonstrated a significant and fatal error in security and election integrity.

          The results of the Antrim County 2020 election are not certifiable. This is a result of machine and/or software error, not human error.

          The tabulation log for the forensic examination of the server for Antrim County from December 6, 2020 consists of 15,676 individual events, of which 10,667 or 68.05% of the events were recorded errors. These errors resulted in overall tabulation errors or ballots being sent to adjudication. This high error rates proves the Dominion Voting System is flawed and does not meet state or federal election laws.

          These errors occurred after The Antrim County Clerk provided a re-provisioned CF card with uploaded software for the Central Lake Precinct on November 6, 2020. This means the statement by Secretary Benson was false. The Dominion Voting System produced systemic errors and high error rates both prior to the update and after the update; meaning the update (or lack of update) is not the cause of errors.

          In Central Lake Township there were 1,222 ballots reversed out of 1,491 total ballots cast, resulting in an 81.96% rejection rate. All reversed ballots are sent to adjudication for a decision by election personnel.

    1. Judge Rothstein is from New York and attended Cornell and Harvard Law School. She was a prosecutor (hardly a leftist occupation) for almost a decade. For the last forty-one years, she has been a nonpartisan federal district judge. From 2003-11, she was the Director of the Federal Judicial Center, appointed by a Republican-appointed Chief Justice of the United States under a Republican President. Since 2011, she has mostly heard cases in Washington DC, in addition to some in Seattle.

If you don’t think that most judges do their best to decide cases on the law and facts, rather than on party politics, you are free to propose an amendment to Article III of the Constitution to replace judges in black robes with lynch mobs in buffalo helmets and war paint. Judges are affected by their judicial philosophy, of course, but rarely by loyalty to the political party that appointed them. See how the Trump appointees lined up on Texas v. Pennsylvania, for example. If the courts were purely political there would be no reason for having them. We could save some tax money and settle our disputes with gunfights.

      1. Antrim county is an interesting case. The computer tally and the result from the voting system didn’t match, which initiated a further investigation and later a manual hand count delaying the Antrim county’s result report which showed as 0% reported for a few hours even after every other county had reported in. In the end the votes were certified with Trump winning the county. The change in actual vs error was a total of 12 votes.

        Once more, extrapolating from a single case to the entire nation, let alone the whole of Michigan State is unwise. Antrim county represents about 22K of 8.1M voters in the State after all.

      2. Texas Attorney General Paxton has made election fraud a huge priority of his office, more than doubling the resources of the Election Fraud Division since 2016. They have, to date, successfully prosecuted 16 cases. The woman in San Antonio was conspiring to assist real voters to cast real votes in a procedurally unlawful manner. She bragged that she might deliver 1600 votes, but there is no evidence that she actually delivered more than a handful (who were, again, real voters casting real votes, not fraudulent voters). That is evidence that fraud is possible and exists, but it is not evidence of fraud on a scale that could flip a statewide election. These particular illegalities benefited a Republican House candidate (who lost anyway), so they are not evidence of a Democratic plot.

        The Antrim County report is laughably riddled with errors. The claim of a 68% error rate is flatly untrue.

  6. I bet dollars to donuts that the majority of “right-wing” conspiracies on the web were actually planted by the left to give the elites a huge reason to lock it down. The left is afraid of what the smarter conservatives know, they don’t want us freely conversing in public about what we know, are sharing, and finding out.

      If you go that far, consider that it could be the right-wing that promotes the idea that it’s the left pretending to be the right-wing when it is actually the right-wing leaving ‘crumbs’ to ‘prove’ they’re left-wing pretending to be right-wing. All to seed doubt among the less informed/analytical members of all groups.

        I’ve saved lots of articles over the last 10 or so years on white racist or homophobic, etc incidents that turned out to be faked.

        And in fact, there was a number of articles last year about a liberal who fooled quite a few conservatives with wild conspiracies on social media. This is how the left works.

        The left wants to shut down free right wing speech, not because of ‘dangerous’ conspiracy theories, but because they are afraid of what smarter conservatives might find.

      2. The left has a track record of faked right-wing incidents going back years based on the news articles I’ve come across. And I’ve already read of one liberal fooling conservatives with conspiracy theories. Very likely much of the recent conspiracies out there that appeal to conservatives are placed there by the left precisely to get a control on free speech.

        For some reason, the left wants speech control on the right. Not because of ‘dangerous’ theories, but because of what we do know.

        For example, during the ’90s (I’m paraphrasing from memory, I have all the articles saved but don’t have time to read them again and post the links), Clinton and the DNC were found to have received illegal contributions from the communist Chinese government and as I recall, were forced to return the money.

        During the 90’s, Clinton was against giving China PNTR. However, near the end of his term, he changed his mind and approved it as did most republicans and a smaller amount of democrats.

        In my opinion, Clinton changing his mind was political payoff to the communists precisely because the communist Chinese government had donated to Clinton and the DNC. Its how politics works.

        Republicans stupidly went along with it because they feared US manufacturers wouldn’t be able to compete with lower cost china made goods (as well as some other reasons).

        After PNTR was signed, we lost over a third of our manufacturing jobs and in fact, had the largest ever drop in mfg jobs in recorded US history. In addition, news articles reported that when for example, a plant with a little over 2000 workers closed in a town, it resulted in over 30,000 other people losing their jobs and 100,000 negatively affected.

        All in all, China scarfed millions of mfg jobs from us and caused many more collateral jobs losses. Thank you Clinton.

        China’s small investment in the DNC and Clinton turned out to be a MASSIVE financial bonanza for them, they’ve increased their wealth, their standard of living (exception, pollution), and their number of rich and middle class has exploded. Why? Because they took our mfg jobs where you take natural resources from the earth, process them, build them into things people want and need, and then sell them at a profit.

        Some say our drop in CO2 emissions is because of green energy. IMO, the majority of the drop in CO2 is because our mfg jobs went overseas. You can see it in graphs of China’s CO2 emissions, they spike up more right after PNTR as signed and ours shows a slight downward tick at around the same time.

        This kind of stuff I just posted is what your side does not want us to share with others.

However, we object to being forced to help you share what we regard as dangerous untruths at best and incitement to insurrection at worst. There is no constitutional difference between the Government forcing you to say something you do not believe and the Government (legislative, executive, or judicial) forcing FaceBook to promote something it does not believe.

        3. The laptop story is disputed. Reasonable people might either believe it is a real occurrence that provides relevant information to the public or that it is an unconfirmed hit job intended to manipulate an election. You are certainly entitled to believe the former,but FaceBook is entitled to believe the latter. You have the right to act on your belief by spreading the story, even if you are mistaken. They have the right to act on their belief by not spreading the story, even if their belief is mistaken.

          Under our Constitution, that is how free speech works. Neither of you have a right to go to Congress, or the President, or the courts to have the Government take a side in your dispute and force one of you to spread a story they disbelieve. We have a First Amendment to prohibit exactly that.
