“The US International Trade Commission staff has agreed with the preliminary ruling by Administrative Judge Thomas Pender that Samsung stands in violation of four Apple-held patents,” Electronista reports.
“The ITC staff has supported the initial ruling, saying that Judge Pender ‘did not commit legal or factual error’ and denied Samsung’s petition in its entirety,” Electronista reports. “A full and final ITC decision is still coming, but the staff decision is likely to weigh heavily in any final ruling.”
Electronista reports, “Apple filed the original complaint in June against six smartphones and two versions of the Galaxy Tab.”

Florian Mueller writes for FOSS Patents, “While the staff’s position ups the ante for both parties’ push for the ALJ to be overruled in different areas, I doubt that the ITC will order an import ban in such a high-profile case without any Commission review.”
“I guess the parties will get the chance to comment again on some of the key issues raised in the petitions for review. This will also help the Commission to bulletproof its ruling for the appeals,” Mueller writes. “In this case, the most likely scenario is that either party will appeal the unfavorable parts of the final ITC decision to the Federal Circuit.”

To me, the MDN headline context said
“ITC confirms its OK that Samsung violated 4 Apple patents.”
Yeah, it should have said “…upheld court ruling that Samsung violated…” Regardless, this is good news for Apple. I do not hold any false hopes that Samsung will ever be held fully accountable for its blatant copying of Apple’s products. However, I am hopeful that Samsung will be forced to pay a painful amount and that the decision will eventually lead to action against the ringleader, Google.
Keep the cattle prod lit up and up the ass of the Sam’s Dung infringer fucks for as long as it takes.
