Big win for Apple: Dutch court orders EU-wide preliminary injunction against Samsung Galaxy smartphones

“The Rechtbank’s-Gravenhage (a Dutch court in the city of The Hague) today issued an EU-wide preliminary injunction against Samsung’s Galaxy smartphones — but not the Galaxy tablets — at Apple’s request,” Florian Mueller reports for FOSS Patents.

“In legal terms, the order does not bind Samsung’s Korean parent company — only three different Samsung subsidiaries registered in the Netherlands — with respect to other countries than the Netherlands,” Mueller reports. “However, it is my understanding that Samsung’s European logistics use the Netherlands as the primary hub. If Samsung’s Korean parent company wants to exercise its freedom to ship into other European countries despite this injunction, it will have to reorganize its logistics chain in Europe accordingly.”

  1. I suppose Vincent van Gogh’s close relatives and descendants will never get to appreciate Samsung now.

    On the other hand Gaddafi is still on the lam and could pass his time watching renegade videos on his Galaxy Tab if it were to be airdropped on Libya now that Samsung has to get rid of surplus stocks somewhere.

  2. This makes me proud to be a Dutchmen!
    Still, it is not a big win I fear. Since Apple did not pay administrative fees in a number of European countries Samsung is still free to ship to these countries. Samsung has plenty of time to rearrange it’s logistics so it won’t depend on Dutch ports. Furthermore, Samsung announced to alter the software and how it handles photos so it won’t infringe on that patents anymore….

    1. Ubermac, I fear that there is no way to deter crapware manufacturers. They defend against lawsuits the old fashioned way – by going out of business under the old name and starting up a new company, which has to be sued all over. Also they make sure that the company has no assets to seize.

    2 got thrown out
    1 got invalidated

    1 got uphelp and samsung already said a minor patch will be released to fix it, and samsung phones will be free so sell like hotcakes on this planet

    oh the biggest claim that samsung is copying the look and feel of Apple products got laughed out of court

      1. Did you actually read the judge statement? or just the headline of this news?

        Out of 3 patents in question, only 1 is applicable. Patent 2,058,868 (the Gallery sh!t) is what Samsung (or should I say all 2.3 phones) infringing upon.

        Rest 2 patents – 1,964,922 and 2,098,948 are not being infringed upon. Over that the design and “designs, copyrights and slavish (style) imitation” were all ignored by the court.

        This gallery patent is still not valid in Austria, Belgium, Czech Republic, Estonia, Greece, Iceland, Italy, Latvia, Lithuania, Portugal, Romania, Slovenia, Slovakia, and Spain.

        it’s also reported that 1,964,922 is null and void for apple.

        Do you also know that the Gallery yapk is part of default android 2.3 and NOT just Samsung gallery? What they need to do is just modify the apk and ensure that it scrolls in a different way.

        And the BIGGEST thing happened in the court was that judge did not find the design of Tab, Galaxy phones noway “copying” apple designs. That’s a killer!

        1. A small correction: the patented behavior is NOT present in vanilla Android, this seem to be a Samsung modification.

          Still, I suspect Google will try to invalidate this patent, since there are some prior art for the “bounce back” technique that the patent build upon.

  4. With Apple winning in so many places it must be so obvious that Samsung is in violation of copying the iPad and iPhone.
    If they want to be a supplier of parts for other companies they should not take the designs and put them in there own products to make more money with. The obvious copycats will now learn a lesson and not get away with it. Apple works very hard developing its own products, stealing from them and making cheap, crappy copycat products should be dealt with by not letting the copycats getting money out of it.

  5. It is amazing how all of the fanboys are so quick to cheer and accuse so many companies of ripping off Apple’s ideas, but yet when Apple takes a great idea that Android has had for years like the notification center, and adds it to their IOS there isn’t a peep. Double standards make me sick

      A better approach: SHOW us how iOS (not IOS) ‘notification center’ is ripping off something similar in Android. Personally, I’m waiting to actually HAVE iOS v5 before I judge ‘notification center’.

      It’s AMAZING how convincing actual FACTS are in any argument. Ranting on and on about vagaries is a waste of time and makes anyone, such as yourself, sound insincere and absurd.

Saying Android had any particular feature for years is almost laughable… Android came out as a response to the iPhone OS, which was developed while their CEO mole was on Apple’s board of directors. They they ripped off Java programming, complete with Sun programmers notes included, to rush Android to the market… what you said is about as hilarious as all those kids who grew up thinking Macintosh copied Windows… or that the earth is 10,000 years old, or that Adam ate a forbidden ‘apple’ and was cast out of Eden by an invisible god.

  6. Big win, lmao. Besides Samsung winning the entire case, this is the best result Samsung could ever get. I’m sure they’re very happy (like me).

    Out of the 3 patents only 1 is valid, which can be easily fixed with a software patch. Samsung will probably write that patch within a week. Even if it takes longer, they still have 7 weeks (!) to fix it.

    Another option for them is to change the name from the SII to say, the SIIa. That phone would not be forbidden to sell and Apple could start all over again with their case.

    So please, change the title of this article. I know this is a Mac site but come on be a bit more realistic and focus on the facts instead of censoring the news.

    1. Yea try to change the outcome in your own little world, read it completely, Apple has a different court case coming up that takes care of the look and feel.

      So yes Apple won, and you Apple haters can go pound sand if you think the complete case is over.

      This was to stop distribution immediately, but he other case can and will stop it and Samsung cold in it’s tracks.

      So before you celebrate that Apple lost get you facts correct and dont try to make it look like this is all over and done with copy-rite violation and the look and feel because that has not lost yet through the other court.

      Apple filled different cases in different courts in the EU, and it’s not over yet sunshine.

    Predictable…predictable.
    Samsung will have the gallery app modded faster than Apple can steal an idea. Well, not THAT fast, really. Noone can thieve like Apple, really. I mean, they have it down to, quite literally, an art.
    P/N 1,964,022 (Slide to unlock) ruled invalid – STOLEN idea from Nieonode’s N1M, which will most likely invalidate U.S. Patent No. 7,657,849 , again, as a STOLEN idea and prior art…

    BOOM!
