“Apple will not be allowed a new trial on damages for infringement of its patents by Samsung Electronics, a U.S. court decided Monday,” Loek Essers reports for IDG News Service. “Apple had asked Judge Lucy Koh in the San Jose division of the U.S. District Court for the Northern District of California for a retrial over some patents. It made the request after a jury awarded it $119.6 million in damages in May, much less than the $2 billion [for which] it had asked.”
“Apple argued it was unfair for the court to allow the jury to reach a verdict and calculate damages based on ‘false information,’ which prejudiced Apple, according to the order,” Essers reports. “However, Judge Koh concluded that the information was not false.”

“Koh also swept aside Apple’s other arguments for a retrial,” Essers reports. “She also denied the majority of Apple’s requests to overrule the jury verdict… However, she granted Apple’s request for supplemental damages. ‘The Court agrees that an award of supplemental damages is necessary here, as there are sales for which the jury did not make an award, because they occurred after the jury reached its verdict,’ Koh said, adding that this would include sales of the Galaxy S III and the Galaxy Note II.”

“Late in August, Koh also denied Apple’s request for an injunction on U.S. sales of infringing Samsung products, including the Galaxy S III smartphone because the company failed to convince the court that people were buying Samsung products because of the infringing features,” Essers reports. “Apple will appeal that ruling.”

Since Apple won’t hire a private investigator to look into her bias, Carl Icahn ought to.
Appeal to a higher court.
Part of being denied on its motion to retry is that now Apple has an appealable issue (among many others). You have to do the procedure in the correct order or you lose potential avenues.
OTOH, it’s about time for this case to wrap up. Apple is clearly moving on by innovating its way so far past what Samsung can do that soon it won’t matter if Samsung wants to copy Apple, because it simply can’t. Apple Pay? Good luck with copying that, even if Google tries to expand its Google Wallet farce. Apple Watch? Already miles past Samsung’s farce of a watch. HealthKit? WatchKit? Right.
What we’re seeing now is Apple turning on the turbochargers and rocketing so far past what Samsung can possibly think of doing. The materials, the engineering, the thought going into details, etc. etc.
I’m not so certain of the outcome of the release of the larger Apple iPhones. I agree there will be a lot of sales to those Apple “fans” that couldn’t deal with a 4″ phone vs. a phablet, but I’m not sure there were many of those who went out and bought Scamscum dreck. I was at the dentist’s office yesterday and I was amazed at the number of people working in the office that had Galaxy dumbphones. When I asked if they were all planning on buying Apple’s next phone, given that it would be bigger, every one of them told me that they like their Galaxy crapware. Especially, they think the camera takes better pictures. What can I say?
You must see a Dentist in a very low income area.
I’ll bet most of those people have never used an iPhone for any length of time. And whether or not many iPhone buyers want a 5.5″ screen, they now have that option. I like the size of my 5S, but sometimes I wish the screen were a little larger (and sometimes I’m glad it is smaller). Guess I just need two iPhones!

@rdiddly, MDN has frequently made the point that the larger sized iPhones will affect high-end sales, the “well-heeled” people who have disposable income and wanted a larger iPhone, but ‘settled’ for a Samsung or other brand that offered this feature. There are a significant number of people willing to make the switch to Apple when the time comes. The people who you saw at the Dentist’s office likely have no such brand loyalty and make their purchases based on price alone. These people are not Apple’s target market.
