Apple v. Samsung Live Blog: Trial opens with one juror gone, Samsung begging

Apple and Samsung “got their first chance to present arguments in their patent dispute to jurors in a San Jose, California, federal court today,” Connie Guglielmo reports for Forbes. “But before the jurors who were selected yesterday even got a chance to step into the courtroom, Samsung went on the defense, asking U.S. District Court Judge Lucy Koh to reconsider a request to allow exhibits the Korean company says shows that its smartphone designs were in progress before Apple introduced the iPhone in 2007.”

“Apple, which filed suit against Samsung in April 2011, accused the company of copying the designs for the iPhone and iPad. Samsung countersued in June 2011, saying Apple had copied some of its own designs,” Guglielmo reports. “Judge Koh dismissed the request, saying that she had already ruled three times on the exhibits and they would not be presented to the jury. That didn’t dissuade Samsung from continuing to push and even ‘beg’ that the court reconsider. ‘What’s the point of having a trial?’ John Quinn of Quinn Emanuel Urquhart & Sullivan. ‘They want to create a completely false impression that we came up with this design after January 2007.’ As he continued to press, Judge Koh showed her annoyance. ‘Don’t make me sanction you,’ she said. ‘I want you to sit down please.'”

Guglielmo reports, “That wasn’t the only drama before the trial started. Judge Koh said one of the three women on the jury had asked to be excused after learning that her employer would not pay her while she did her jury service. Apple and Samsung allowed her to be dismissed, with leaves 7 men and 2 women now serving on the jury in what it expected to be a four-week trial.”
