“Samsung has officially stated that it plans to bring the hammer down on Apple’s ‘free riding’ on its patented 3G wireless technology,” Chris Foresman reports for Ars Technica.
“Among its latest moves is a lawsuit seeking to ban Apple’s iPhones in The Netherlands, where Apple recently won an injunction barring Samsung from selling its Galaxy S-series devices in the European Union,” Foresman reports. “Because the patents in question are essential to 3G standards, however, Samsung’s strategy to sue over these patents may not be as successful as it hopes.”
Foresman reports, “Samsung claims that numerous other manufacturers have licensed these patents while Apple has not, but Samsung apparently never made any offer to license the patents to Apple on FRAND or any terms according to legal briefs filed by Apple in US court. Furthermore, Samsung’s use of FRAND-encumbered patents against Apple could constitute a violation of antitrust laws both here and in the EU. At least, that’s the argument Apple is making. From our conversations with several IP experts, our understanding is that suing over FRAND-encumbered patents is frowned upon by courts in the EU in particular.”

MacDailyNews Take: Boycott Samsung. We no longer buy Samsung-branded products and advise our millions of readers worldwide to also avoid purchasing Samsung-branded products until they cease stealing Apple’s patented IP.
What are those flat-face Samsung executives are thinking?
Let’s keep racism out of the discussion.
and your face is …… ?
All you apple cry babies on here defending apple are the same dudes that got picked last to play for someone’s team in school.
Well with a handle like App Geek, it’s not hard to figure out it was you that got picked last for anything.
Ohh snap….!
How bout you ask your mom PAL 😉
That doesn’t even make sense NTSC
LOL, you wish! If I got picked last, it’s only because there were 9 All-Americans on my lacrosse team! Johns Hopkins ’84
Aww c’mon you guys, App Geek did get picked first… for cluelessness. Second for Best Troll.
Christ, not you again. Get back under your bridge
and pick your nose or something. You’re too ignorant and stupid to understand the subject at issue here.
Nope, not me, ace. Used to land jet aircraft on U.S. Navy aircraft carriers. Before you go slapping wimpy handles on commenters here, pray tell us what’s your claim to fame there “app geek.”
STFU, moron.
Samsung! Super Genius.
Come on MDN, drop the political agenda and post an online poll to see how many of us will boycott Samsung products, run it for a month and send the results to Samsung.
You’re a moron. Dont you think it would be a bias poll since MDN is ONLY an iPhone app.
Must be embarrassing to be dumber than a moron, ‘cos I’m not posting my response to you using any App.
Care to humiliate yourself even more? If so, keep on writing, you’re doing a spectacular job so far.
He’s a moron? Only an iPhone app? Who is the moron? Look in the mirror dude.
There you guys go getting your panties all in a bunch. Didn’t know I had to get all technical with you guys, I’m sure that moron posted that on an Apple centric website which means it would be abias poll since people go there to get they’re apple news.
There’s no “their” there
So judging by your grammar you are a ten year old. hang on, what am I saying? Ten? No! More like 6.
Whew….Embarrassing.
Oh, by the sound of things in your previous posts you are being selected last at school. Otherwise why would you bring up such a middle school type of thing like that. Adults don’t even think that way you dumbass!
App Creep, you are about as dumb as a stick of wood. I don’t have an iPhone, and I’m here… Are you using an iPhone? Somehow I kind of doubt it. It would probably be way too complicated for you to understand.
i drank the apple kool-aid years ago, but i will never give up samsung televisions…. NEVER. EVER. NEVER.
Actually, I have contemplated your question. I am not a moron. I am a physician. I am considered fairly intelligent by my patients, family and colleagues. Moron is actually a term used to describe people with mental retardation. It is no longer in use, but used to mean “(Psychology) a person having an intelligence quotient of between 50 and 70, able to work under supervision.” I am self employed and make a good living, supporting a number of other people to make their livings, as well. How about you?
Hey, Mike. where do you practice? I want to make sure that I don’t choose you for my medical care, unless, of course, you are a pathologist.
and let’s not forget “imbecile” and “cretin”
oh yeah, and “idiot”
MacFreak, no worry. There is no need to come in just pick one of the diagnoses in this string and go from there.
MDN posters, don’t argue with trolls. They could be like 10 years old or at least have the mentality of one.
As far as this original MDN post says, why not boycott Samsung? There should be a poll.
I am boycotting Samsung. Was looking at buying a compact digital camera from them but will pass and likely get a Cannon or Sony.
If Samsung, wasn’t being a jerk with the lawsuits and wasn’t so shamelessly copying Apple stuff, I would be ok but too many low blows from Samsung and I as a consumer, have had enough.
Make sure it isn’t a loose Canon
This “boycott Samsung” nonsense is idiotic, petty and pathetic.
The legal spat that Apple is having with Samsung is just one of many that Apple are currently engaged in. Apple have been the instigators in many of these things. With Samsung it’s six of one and half a dozen of the other as to who is in the “wrong”, with dirty tricks being played on both sides.
I’m personally equally disgusted with how both Apple and Samsung are using and manipulating the patent system. I am, however, not going to boycott either of them, and will be one of the first in line when the iPhone 5 comes along.
I also fully expect the iPhone 5 to contain several components manufactured by Samsung, just like my brand new MacBook Pro and iPad do, and I’m sure that the iPhone 6 will do too.
By the time iPhone 6 rolls around, there will be NO SamDung parts in any Apple product.
And what dirty tricks on Apples part are you talking about. Surely you don’t mean standing up for ones IP rights is a dirty trick…do you?
Yes, I have already been boycotting Samdung “branded” products. TV’s, Fridges, you name it. And on top of that I have been stopping everyone I know of from buying their products.
Since Apple is a the world’s largest customer for flash memory, and Samsung is one of the world’s largest manufacturers, it’d be difficult for Apple to completely cut them out of their supply chain without increasing their costs significantly. Apple are not in the business of cutting off their noses to spite their faces – they’re in the business of making money.
As for Apple’s dirty tricks, they have a number of highly spurious software patents (along with some legitimate hardware ones), and have been using them to mount a systematic campaign against not only Samsung but various other manufacturers of Android mobile phones. Attempting to prevent the sale of the Galaxy Tab on the basis that it’s a black rectangle for example is deeply pathetic, IMHO, and it’s clearly dirty tricks to distort the image of the Galaxy Tab in court documents to make it’s aspect ratio appear to be the same as the iPad. Meanwhile Samsung have been in the business of making mobile phones for at least a decade longer than Apple, have plenty of patents for 3G technologies, which Apple have not licensed.
I’m not saying here that Samsung haven’t substantially copied Apple, but let’s face it, Apple have copied many others in their time. Pot, meet kettle. Two wrongs don’t make a right. Let he who is without sin cast the first stone. yada yada yada.
If Samsung’s behaviour in this affair so concerns you that you feel obligated to boycott them then, if you are morally consistent, you should be boycotting Apple too.
You must also boycott Apple on the basis that they use Samsung components within all of their products.
Personally I’m opting to boycott neither.
“…with dirty tricks being played on both sides.”
When one side has an unpaid parking ticket, while the other is involved in a high-speed chase after a bank robbery, it is a bit silly to try to make it sound like both sides are equally guilty of being in trouble with the law.
Someone correct me if I am wrong. But Apple does not design or manufacture a 3G chipset, they purchase and integrate another manufacturers chipset (IE Infineon) so is it not the responsibility of the manufacturer to licence any patents required?
You are correctly sir. Apple has never gotten a 3G license because they don’t need one. They purchase their chips from qualcomm and qualcomm has already gotten a license for it’s 3G.
Not surprised about this latest desperate move from S(h)amsung. They’re so good at copying & quite shameless about it that Oxford & Merriam-Webster should seriously consider making “Samsung” a synonym for “Xerox”. And no, being Asian, I don’t consider the “flat-face” reference to S(h)amsung’s executives a racist statement. Koreans make flat screens & although cosmetic surgery-over-lunch is quite popular there, they are not flat-faced. No such thing. Flat nose perhaps for some as the Koreans aren’t as blessed, looks-wise, as the Chinese from Shanghai. But that’s another subject matter entirely.
Apple should take all of the business they do with samslum elsewhere. That’d bring major hurt to samslum and make them think twice about biting the hand that feeds them.
