Apple files second U.S. ITC trade complaint against HTC, seeks to block HTC imports

“Apple Inc. filed a second patent- infringement complaint against HTC Corp. at the U.S. International Trade Commission, seeking to block imports of ‘personal electronic devices’ by the Taiwanese phonemaker,” Susan Decker and Tim Culpan report for Bloomberg.

“Apple has been using the ITC to go after makers of mobile devices that run Google Inc.’s Android operating system,” Decker and Culpan report. “The HTC complaint is the second Cupertino, California-based Apple has lodged against the phonemaker in the past 16 months.”

Decker and Culpan report, “A judge is scheduled to issue a decision in that case on Aug. 5. Those findings are subject to review by the full commission, which can block imports of products that infringe U.S. patents.”

  1. Wouldn’t it be more efficacious for Apple to turn into a patent troll and ask HTC to pay a $15 licence fee for every Android phone sold? They’re already paying Microsoft $5 so it’d be fairly easy for Apple to tap them for at least that much.

    What are the chances that the ITC will rule in favour of banning HTC Android phones? Close to nil I’d say.

    1. Apple has a good chance of stopping HTC or at least getting a settlement and payments similar to MicroSoftie ….. and that maybe what it is all about, payments per phone …..

      By the time MSFT and Apple get done with the open (not) Android it won’t be free and at $25 – $45 a copy when all is said and done watch the popularity of Android go down and price of the phones increase ….

    2. Apple make quite a bit more from selling an iPhone than they would from a droid licensing fee. Can’t see that licensing is such a great deal for them. It’s actually a great deal for android peddlers. Piggy backing on apples ip for a small fee.

    3. Why would Apple WANT to turn into a patent troll? That goes against its whole philosophy that money should be earned through the merit of its own products.

      What they’re trying to do with these legal battles is to stop other companies from making near carbon copies of iPads, iPhones, and iOS. Remember eMachines and the PCs they were selling that looked just like the original iMac? There’s a reason why Apple didn’t demand a $15 license fee for every fake iMac sold and leave it at that, letting eMachines continue their design theft.
