Oracle sues Google over Android, claims patent and copyright infringement

Invisible Shield for Apple iPhone 4!“Oracle said Thursday that it has filed a federal copyright lawsuit alleging that Google’s popular Android operating system was built on Oracle’s Java software without permission,” Brandon Bailey and Mike Swift report for The Mercury News.

“Android, which was first released in late 2008, is used by several computer manufacturers as the operating system that runs smartphones and other computing devices,” Bailey and Swift report. “Oracle’s lawsuit, filed in the U.S. District Court for Northern California, accuses Google of infringing on patents and copyrights that Oracle acquired when it bought Sun Microsystems earlier this year.”

Bailey and Swift report, “Google had no immediate comment.”

  1. G4Dualie – A yawner? I disagree. This is huge. Java is Android’s app environment. Android without Java is like iPhone without Cocoa. Google was crazy to base their platform on Java without a license agreement with Sun.

    First Schmidt locks lips with Verizon to end net neutrality and now he’s got Crazy Larry gunning for him. Not one of Schmidt’s best weeks I’d say.

  3. Mr. google CEO said something like, “200,000 android devices sold every…”

    No doubt ORCL knew how many they were selling. But hey, saying that it’s a Larry and Steve thing is dumb. This is about Oracle using Sun’s patents. AND getting a something out of every App and OS copy…

    This doesn’t change anything Apple is doing… All they have to do is flip the switch on for their iPhone on VZ and T-Mobile… and bam! at least double the marketshare…

  4. While I’m no patent attorney, it seems to me that when you use someone for patent infridgement, they are entitled to royalties. The problem is, Google makes NO money on selling their OS, so what can Oracle sue for? Certainly not a monetary reward.

    Just a thought…

    Oh, yeah, that went out the door when Eric T Mole stayed on the Apple BOD in order to gain competitive info. How in the heck that isn’t an actionable offense, I’ll never know.

  6. Lots of the numbers gartner cites as android are nothing more than feature phones. They stamp android on them and yet are not smart phones but fall into the category of feature phones. These phones make little or no money for the manufacturer and will be a big loss if they had to pay royalty to oracle

  7. Hmm. Comparing this to the Microsoft raping of Java via J++ and having Sun sue their ass off, is inevitable.

    However, this is actually more like AT&T suing Berkley University for BSD UNIX (which AT&T lost in 1994) OR Microsoft (via their puppet, SCO Group) suing Novell over their Linux project (which SCO lost in June, 2010).

    Good luck with that.
