“A brazen theft in the Cherry Creek Mall left the victim with a permanent injury to his hand,” CBS News reports. “He had just bought an iPad as a favor for a friend.”
“Bill Jordan told CBS station KCNC he moved his family to Colorado from New Jersey 15 years ago to get away from a crime there,” CBS News reports. “Now after the iPad theft, he said his life and the life of his family will never be the same.”
“Last Thursday afternoon the 59-year-old Aurora man walked into the Apple store to pick up an iPad for a co-worker. ‘I had been asked by one of my colleagues in Canada to pick up an iPad for someone who is being promoted.’ Jordan left the store with his iPad bag tied around his hand,” CBS News reports. “Unreleased surveillance film shows two young men following him.”
CBS News reports, “A few feet from the doors to the parking garage Jordan felt a violent tugging at his arm. He looked down and saw a young man trying to grab his bag. ‘He was almost sitting on the ground he was pulling so hard and it was still tied around my fingers; and it wouldn’t come off and then finally he gave it one big jerk; and that’s when he stripped the skin off my pinky and it went right down to the bone.’ The robber grabbed the iPad and ran out of the mall.”

In the case of the Little Old Lady vs McDonalds over the hot coffee that got spilled, McDonalds had already settled roughly 5000 such claims out of court, but kept on serving coffee at 195 degrees F, about 50 degrees F above what is considered safe. In one case a fellow was injured when the coffee actually melted the bottom out of the cup.
It’s not a case of one person whining and being awarded large damages. The major part of the damages were punitive, in which case the court takes into account the intentionality involved, willful negligence, and prior knowledge of the unsafe practice. Punitive damages are by law whatever it will take to get the perpetrator’s attention. How much money would you think would get McDonalds’ attention? Certainly not anything less than 7 or 8 figures, I would say. I would have awarded several million dollars in this case for sure.
As for the Apple shopping bags, I don’t believe Apple has any prior claims that have been settled about their bags, and thus no prior knowledge. Negligence would be hard to prove, in that under our tort system one can’t be held to have been negligent for not foreseeing the illegal actions of another.

Or you could move to New York City and do all your shopping here!. The crime rate is lower than it was in 1962, and the city is No. 68 on the list of US cities (by crime rate), right between Fresno, CA and Raleigh, NC. Go figure!

Personally, I’m glad the Apple Store bags’ drawstring is so strong. If I get into a tug of war with someone over that bag, I want that bag to hold on just long enough for me to see if the douchebag(s) is/are as lousy at fighting as they are stealing.

Even though I carry my iPhone around without a case, the iPad felt like a big vulnerable target without one.
Years ago, when the PowerBooks came out, my friend in New York went and bought one of the last Macintosh Portables. Her argument was simply that nobody was going to push her over, grab her Macintosh Portable, and run away.
(For those of you kids, the MacintoshPortable weighed in at 16 pounds. You’d have to be in really good shape to run fast and carry a Macintosh Portable.)
Stop gun control and stuff like this won’t happen. Thieves can’t assume you’re unarmed anymore.
Turns out after googling a bit, Colorado has very permissive gun laws. Dude should’ve been packing.
The irony is that this man now has one less finger to use with the multi-touch interface.

I’m retired. I ended up wanting to beat the snot out of the administrators.
Putting the iPad in another bag and having something else in the Apple bag would trick the thieves. That way you can let go of the bag and the perps won’t realize they have been duped until later.
Used to do that when taking cash to the bank. The money bag would have nothing in it and the cash was hidden in my jacket.
Hopefully the video will help catch the thieves.

Can someone comment on the legality (in Colorado) of a person, in a situation like this, using a concealed weapon against the criminal?
I would be personally very pleased to see the criminal be visited with immediate physical pain / injury as a result of his crimes.
However, given that, I do not think it would be legal to kill someone or use deadly force over a mugging like this. Had the criminal in question used a deadly weapon himself, the situation might be different.
A taser on the other hand…that would have been entertaining to use….
Such a stupid crime by stupid people. Apple already has a record of the registration number and before the iPad can be used that registration number will be flagged. How fast can you say caught!!

@Jazzlady – Don’t forget, half of the people in this country are below average intelligence. These two seem to be trying to nail down the bottom end of the bell curve. If they followed this guy around the Apple Store and the mall they are all over video surveillance. As soon as they connect the iPad to the internet a beacon will go off, since the MAC Id will be known. If they sell it, they’ll leave tracks, if they use it they’re caught. Dumb is as dumb does.
