Trademark dispute could delay Apple iPhone in Canada

“A dispute between Apple Inc. and Toronto-based Comwave Telecom Inc. over the Canadian trademark rights to the name ‘iPhone’ has yet to be resolved, adding another barrier to the launch of Apple’s next-generation handheld device north of the border,” CBC News reports.

“Comwave, which markets a collection of voice-over-internet services and products under the name iPhone, has filed its opposition with the Canadian Intellectual Property Office, or CIPO, to Apple’s trademark application for the proposed use of a handheld and mobile device called the iPhone in Canada,” CBC News reports.

“The dispute, currently under review, could further delay the Canadian arrival of the Apple iPhone — a handset with a touchscreen interface, sleek design and both Wi-Fi and cellular service that has already sold over one million units in the United States since its launch in June. It will hit store shelves in Britain and Germany in time for the holiday season,” CBC News reports.

  2. I posted last thursday on the MacNN forums that a representative of Rogers told me that the iPhone won’t go on sale in Canada before July 2008. The girl told me that they were problems to fix before it could go on sale. Among the reasons for the delay, she sited that the phone had to be builingual and that their system wasn’t ready yet for all the iPhone features.

  3. And to anyone else that was wondering.

The Comwave IPhone has been advertising on Toronto and Mississagua buses for over two years.

It’s fairly clear they wish to protect their service.
All it takes in Canada is to have a huge referendum over the need for Apples iPhone to enter the Canadian market.

    So write to Parliament.

  4. No no no… it can’t be about bilingualism.
    Don’t believe that crap.

    My Mac computer is Multi-lingual.
    AND so is the iPhone.

Simply change the settings to display the language of choice.

    —-

It’s about the cost of services to the customers.
And how Rogers wishes to profit from Apple.
Still, Rogers is not ROGERS anymore.
AT&T;Canada runs the Rogers show so this is why three days after the US launch of iPhone… Rogers came out to say Rogers has exclusive first launch of iPhone in Canada.

AND they will. It’s about change though and money.

  5. In Canada.

    I can’t wait until xmas.

    I have been good Ted.
Pls Ted Rogers, pls I am at your merci.
I will cancel my Bell phone now.
    And wait for your reply.

I need iPhone so I can see my own webpage – it’s the best way to cheat on my exams in University. Pls. Ted.

Oh – yes, right, I will return to my evil self after I get the phone.
hahahah cos cheating is bad right… darn ted you are so so kind.
I learnt my lesson. I shall not cheat on my exams again.

Yes, you are wise Ted… thanks for stopping me.

So this is why the iPhone is not in Canada.

Gosh – you are clearly a man to look up to.

Thank you so so much. You are right Apple iPhone should stay out of Canada. We are honest students.

    hahahahahaah

Whatever, now lets see some writer weave this crap into some article just to get on the Apple wave of media.

  6. Well it would make sense for Apple to rename the product invadePhone, since that is a trademark of the AENUS terroristic group already.

I would not be surprised if some AENUS morons think they already have invaded and conquered Canada.

  7. @ Chrissy

“That’s why we have to invade. Keep ’em down before they get too full of themselves with their clean streets and their low crime and their affordable health care. Who the hell do they think they are?”

Lol! You crack me up! 😀

But seriously, i love Canada. Never been there myself, but from what i hear, its all good. Gotta love that country. Seriously.

  8. VOIP is nothing new. I can’t believe that there are people reading here that don’t know about these phones. Sure, you may not have heard about the Comwave iPhone, but to have not heard of this technology at all?

T-Mobile offers a similar service here in the US, plus their phone also works on the T-Mobile cellular service.

I’ve never been with T-Mobile, and I will soon be switching to AT&T;for the iPhone (waiting for house to be built, so I can get the new loan before the credit inquiry of switching networks).

I wouldn’t switch to T-mobile for this service alone, but without the existence of Apple’s iPhone, I might consider it.

Personally, I would love to see something similar developed for iPhone.

  9. Contrary to common Machead belief, the “i” branding has been popular for any internet based product since 1995. It’s not an Apple marketing invention, in fact Apple simply jumped on the “i” bandwagon (and did a much better job of marketing it then everyone else).
Cisco owns the rights to iphone in the US and came to an agreement with Apple. Comwave owns the right’s to it in Canada and I am sure they will also work out something with Apple.
If Comwave has been operating under that name for years now under the branding “iphone” (it looks like they have been using it since 2004) it would cost them a small fortune to change their Marketing and product naming. Apple should offer them a compensation package to change their branding.
But I guess the Canadian consumer is not that important to Apple.
