Analyst: Apple will win court battle with ‘Fortnite’ maker Epic Games

Regarding Epic Games v. Apple, Wedbush analyst Daniel Ives says Apple will prevail in a “Game of Thrones” curt battle versus “Fortnite” maker Epic Games.

Epic Games v. Apple is a current lawsuit brought by Epic Games against Apple in August 2020 in the United States District Court for the Northern District of California, related to Apple’s practices in the iOS App Store. Epic Games specifically had challenged Apple’s restrictions on apps from having other in-app purchasing methods outside of the one offered by the App Store.

MacDailyNews Take: The bottom line is clear: Epic Games wants to enjoy all of the benefits of Apple’s App Store, including access to well over one billion of the world’s most affluent users for free. That is illogical, unfair, and, basically, theft.

Why should we, as developers, be “forced” into using Apple’s pay system when some individual developers cannot even attempt or have the technical know how to use Apple Pay when there are other good (and faster) payment services out there (such as PayPal, BitCoin, etc.) and are easier to use and configure? This is a monopoly if I ever heard one.

      1. So if you have a garage sale, I can demand that you sell my stuff, and I get to decide the cut? Not fair, monopoly! Does Target have to carry my widgets and I get to decide their cut?

        A company doesn’t have a “monopoly” on it’s own stores dumb bunny.

      1. While true, the App Store ‘monopoly’ is IMO being looked at from the wrong perspective. Anti-trust laws are meant to protect the consumer by allowing for competition. While there are many App stores providing Apps for mobile devices, for the iOS device owner there is only one, Apple’s App Store, hence the ‘monopoly’.

        Apple does provide the consumer protection by vetting Apps for safety and privacy. And provides the developer/brand a distribution point, marketing and payment system. All well worth the cut they take.

        At the same time Apple’s App Store policies, for good or bad, restrict Apps that otherwise meet Apple’s privacy and security rules because they fail other subjective guidelines. Developers/Brands that are large enough to not require Apple’s marketing and can manage their own App store and payment system are currently prevented from creating one, For those large developer/brand any security or privacy concern would be detrimental to the reputation they have built up over time in contrast to a smaller developer/brand in effect keeping them relatively honest by necessity.

        In short, allowing 3rd party iOS App stores in no way reduces the benefits and safety to both consumers and iOS developers that choose to deal solely with Apple’s App Store while offering iOS consumers and developers broader choice and opportunities fulfilling the reason for the existence of Anti-trust laws.

      1. You said it bro! At THEIR store. There is no way for me to walk out of Footlocker with Nike shoes from Footlocker without paying Footlocker. No way. See? Therefore, I will pay a markup at Foollocker. See?

        Here is another example just for you. You can’t walk out of Walmart with Hersey chocolate without paying Walmart IF you took the chocoloate AT Walmart… Are you getting the picture? Yet?

        1. In this analogy, Nike (the maker of the shoe and owner of their own brand stores) is in Apple’s position not Footlocker. Footlocker is a 3rd party (App store equivalent) that can sell Nike footwear. Unlike Apple, Nike allows 3rd party stores to sell their shoes (HW equivalent), laces and socks (App equivalent) alongside 3rd party providers of laces and socks.
