Starbucks wins, Fiat loses, Apple kept guessing in EU tax grab rulings

Starbucks Corp. won a court fight and a Fiat Chrysler Automobiles NV unit lost one over European Union tax orders in decisions that left lawyers puzzling over the impact on Apple Inc.’s chances of toppling a record 13 billion-euro ($14.3 billion) bill.

Even though the amounts at stake in Tuesday’s rulings — about 30 million euros each for Starbucks and Fiat — aren’t huge, lawyers are now poring over the judgments ahead of multiple appeals as companies, including the iPhone maker, counter EU Competition Commissioner Margrethe Vestager’s five-year crackdown on allegedly unfair tax deals… The EU General Court in Luxembourg said Tuesday that the EU failed to show that coffee giant Starbucks obtained an unfair tax deal by the Netherlands. The judges threw out a similar challenge by Fiat over its fiscal arrangements in Luxembourg…

In the Apple case, the EU said Ireland illegally reduced the company’s tax bill, a finding Apple and Irish officials don’t accept.

Apple declined to comment Tuesday beyond pointing to its remarks in a hearing in its own appeal at the same court last week. It told judges it’s “now paying around 20 billion euros in tax in the U.S. on the very same profits that the Commission says should also have been taxed in Ireland.”

    I’ve given up on pointing out that the implication that this is a “grab” motivated by EU greed ignores the fact that the European Commission triggered this very expensive litigation without any possibility of receiving a single euro beyond reimbursement of its legal costs. The US is careening towards losing its middle class as corporate giveaways enrich the few while small businesses and workers are given tax increases cleverly wrapped in a patriotic-sounding label: tariffs. If and when interest rates ever return to what most economists consider to be healthy territory, the real borrowing costs will eat an unprecedented chunch of the national budget. International dictators laugh at Trump. No international deals have been signed, no arms reductions, nothing at all to make the US more secure. US corporations, already sitting on piles of cash, are buying back their own stock rather than building any new factories in the US of A. Can you name one thing Apple has done differently under Trump than they did under Obama, other than perhaps a few more awkward Tim Apple photo ops?

    Far too many people have settled into the “taxes are evil” and “taxation is theft” camps without being willing to sacrifice any of the services that they receive from the government. In recent decades, almost every GOP POTUS has enacted massive tax cuts in combination with massive spending increases (generally on DOD), and the result has been rising deficits and huge economic crashes. The exception to that rule is George H.W. Bush, and his own party disinherited him as a traitor because of some pragmatic tax adjustments. He was by far the most qualified GOP POTUS in decades and his own party tanked his reelection.

    Get a clue on life. End the persecution complex. End the deep state conspiracy obsession. End the twisted mindset that lies and corruption are acceptable as long as they promote the GOP causes. This has to stop.

      The U.S. treasury has not balanced the federal budget since 1969. Every president of both parties carried a deficit since then.

The 2001 terror attack hurt the economy, and the US started 2 overseas wars, cut corporate taxes, and enacted Medicare Part D while doing nothing to regulate increasingly complex Wall Street games while Dubya declared Mission Accomplished. The bottom of the economy fell out in 2008-2009 and BOTH PARTIES supported massive deficit spending to stimulate the economy. While that massive debt was entirely disgusting to some of us, it did in fact pull the world out of a great recession and led to a decade of economic growth. So one would expect that it would be a perfect time to pay down accrued debts, right Goeb? Isn’t that what Candidate Trump promised? Exactly the opposite is happening. This corrupt administration is carrying the highest deficit ever, increasing the accrued debt faster than Obama or any prior peacetime administration. Trump presides over a debt that is currently 77% of GDP and rising fast. That’s double the debt that FDR ran when his New Deal programs beat down the Great Depression. That’s 2.5 times what Lincoln incurred when winning the Civil War.

          In actual terms, Don The Con will add 7-8 trillion dollars to the US debt. Keeping the tradition of exponential debt growth by both corrupt parties since 1980.
