“Deferred Action for Childhood Arrivals, more commonly referred to as DACA, is a controversial Obama-era immigration program that helped undocumented immigrants who arrived to the US as children work and study without the fear of deportation,” Roger Cheng reports for CNET. “They’re referred to as Dreamers.”
“The program will end after a transition period over the next six months, US Attorney General Jeff Sessions said in a press conference on Tuesday,” Cheng reports. “The move by the Trump administration fulfills one of the campaign promises made by President Donald Trump.”
“Cook, in an email to employees obtained by CNET, vowed to work with members of Congress to ‘advocate for a legislative solution that provides permanent protections for all the Dreamers in our country,'” Cheng reports. “Cook said Apple would provide support, including advice from immigration experts, to the Dreamers who work at Apple.”
Sessions said the DACA program represented an overextension of the president’s executive power and said it was up to Congress to set up immigration policy. ‘As the Attorney General, it is my duty to ensure that the laws of the United States are enforced and that the Constitutional order is upheld,’ he said during a press conference. ‘Ending the previous Administration’s disrespect for the legislative process is an important first step,'” Cheng reports. “Cook said Dreamers work for Apple in 28 states, and that for many, the US is their home.”

They help customers in our retail stores. They engineer the products people love and they’re building Apple’s future as part of our R&D teams. They contribute to our company, our economy and our communities just as much as you and I do. Their dreams are our dreams.
I want to assure you that Apple will work with members of Congress from both parties to advocate for a legislative solution that provides permanent protections for all the Dreamers in our country.
We are also working closely with each of our co-workers to provide them and their families the support they need, including the advice of immigration experts.

I just sent a MacBook Pro to a DACA kid starting college in the fall. I met him when he was just a little thing and we bonded over Teen Age Mutant Ninja Turtles. His father used to clean a building I worked in. Now he’s majoring in physics with dreams of working for NASA. His father helps me out on occasion.
It’s easy when it’s ‘them’ but once “they” become people, it all gets blurry.
While Obama was wrong to try and create immigration law via executive order, these are not typical criminals. They are not murderers, rapists, drug gang people, and thieves. They are people who have bought off on American culture, celebrate it, embrace it, and live it. They are pushing education, excellence, success, and achievement. We do have common values. IMHO they deserve to be here, far more than many of the people who were born here and have nothing but hate for America.

I posted a long item on this issue on the other thread today, so I won’t repeat it. They are not “illegal aliens.” About half of them were brought into the US legally and their families then overstayed their visas. That is not a crime even for an adult, but a “civil offense,” like overstaying the time you paid for on a parking meter. The adults can be deported but not imprisoned.
The other half were brought in illegally, but since they were below the age of criminal responsibility, they have committed neither a criminal nor civil offense. It isn’t a crime to be in the US without citizenship, and never has been, or the government would have been prosecuting the American Indians before they became citizens in 1924.
DACA was simply a recognition that the US Government cannot go out today and deport 11 million undocumented persons before tomorrow. It has to set priorities, with the highest being those who have committed serious violent offenses and working down from there. Unless Congress hands ICE the Defense Department budget, they are never going to reach the lowest priority people. Clearly, that is the young folks brought to the country as children who have unspotted criminal and educational records—the Dreamers.
That leaves the question of how to handle those lowest priority undocumented aliens. Are we (1) going to allow those people to remain in the country indefinitely without the ability to attend college or legally hold a job while waiting for them to commit a crime to feed themselves, or (2) let them get work permits under a plan to eventually achieve legal residency and citizenship?
Seems pretty simple to me.

Actually, Obama has admitted nothing of the kind. He has explained DACA as an exercise of prosecutorial discretion, a concept that is well recognized and has been since the dawn of the Republic. It works like this:
There is not, and never will be, enough police to investigate every crime and arrest every criminal. Law enforcement has to make choices every day, like whether to spend the time to book a shoplifter or respond to an armed robbery call. Likewise, there aren’t enough prosecutors or courts to try everybody who could potentially be charged with a crime.
Given the unavoidable need to allocate limited resources, serious crimes get prosecuted while petty offenses are plea-bargained down, dismissed, or never filed. That will be true as long as the taxpayers are unwilling to pay for all the investigators, prosecutors, clerks, and judges that would be needed to try everybody, and for all the jails that would be needed to house them.
The Supreme Court of the US recognizes this concept and has held that the people who are prosecuted have no right to complain because other people were not. Prosecutors can only try cases one at a time, and they should start with the most serious and work their way down.
An additional factor is that public prosecutors are subject to an ethical duty “Not just to prosecute cases, but to see that justice is done.” Again, that dictates that serious offenders go to trial and prison while petty offenders sometimes walk. The people who represent a public danger will always be the highest priority.
DACA is simply a set of guidelines for the Department of Homeland Security to use when determining who should be deported because they are not a citizen and who should be denied the opportunity to work while they remain in the country indefinitely due to being the lowest deportation priority.
Obviously, it would be preferable for Congress to write the guidelines for exercising prosecutorial discretion, rather than doing it by an administrative rule. President Obama gave the Congress every chance to do that and it failed to do so. At that point, the only remaining choices were to allow individual federal employees unlimited discretion in setting priorities for enforcement or adopting uniform national standards—DACA, in other words.

My wife is a naturalized American citizen born in the United Kingdom, so I have some experience in dealing with the immigration process. Even given “ample time,” legal immigration isn’t easy… if it is even feasible.
It is essentially impossible for someone who is inside the United States without legal authority to “get legal” without leaving the country and applying for legal entry at a foreign US Embassy or Consulate. New applicants go to the end of the line and must compete for a limited number of entry slots with those who have no history with the USA.
If the family left their country of origin because it wasn’t safe to live there (think Helmand Province or Sinaloa State), it is going to be a lot more unsafe for somebody who has never been there as an adult, doesn’t know the local culture, and may not even speak the local language. In some cases, the child was born after leaving his parents’ original country but before arriving in the US, so it isn’t even clear what his citizenship is or how he could possibly locate the required documentation to file a visa application.
To repeat: these are cultural Americans who have never been an adult in any other country. To qualify for DACA, they must not have a criminal record and must be either working or in school. What is the point in deporting them under circumstances that may not allow them to ever come back?
“DACA applies to individuals up to age 31 (as of June 2012, so 35 now) — hardly children; consequently, many Dreamers have long-since terminated their studies and most have committed multiple felonies in order to get jobs — Social Security fraud, forgery, perjury on I-9 forms, falsification of green cards and drivers’ licenses, identity theft, etc. Dreamers continue to commit these job-related crimes right up to the day their DACA status is approved and they obtain work permits and their own genuine Social Security numbers.

The real problem is once you make an exception for one class of people, that becomes a slippery slope that will be used against the government to allow another class of people to skirt the law and stay. I truly feel for the Dreamers, but where does it end? Most other countries do not tolerate immigration violators like we do. Maybe there should be an exception and be allowed to apply for citizenship under some strict but expedited rules, but then again, somebody would cry foul and it never ends.
The U.S. allows immigration violators with a caveat. Allow me to elaborate, TD:
Democrat administrations pass laws allowing the SPECIAL exemptions, like the gold standard DACA.
Democrat administrations do not enforce U.S. border laws fully telling officers to stand down.
Democrat administrations create safe spaces for illegal aliens called “sanctuary cities.”
Democrat administrations encourage local police departments to defy the law by not holding violators, detaining illegals or cooperating with ICE and other federal officials.
Democrat administrations free illegals multiple times into the general population and some commit murder of innocent citizens indiscriminately (Kate).
Democrat administrations fight tooth and nail to DENY transparency in our voting booths called vote ID.
Democrat administrations have no problem using taxpayer dollars collected from ALL parties to be used in various forms by illegals.
I’m sure I missed a few.

America promises all its people the opportunity to achieve their dreams through hard work and perseverance. At Apple, we’ve dedicated ourselves to creating products that empower those dreams. And at our best, we aspire to be part of the promise that defines America.
Earlier today, the Justice Department announced that President Trump will cancel the Deferred Action for Childhood Arrivals (DACA) program in six months if Congress does not act to make the program permanent.
(Actually, the announcement said that the program would be cancelled whether or not they acted, so they had best get busy!)
I am deeply dismayed that 800,000 Americans — including more than 250 of our Apple coworkers — may soon find themselves cast out of the only country they’ve ever called home.
(It may be the only county they’ve ever called home, but if they had officially, legally made themselves Americans, it would be a non-issue.)
DACA recognizes that people who arrived in the United States as children should not be punished for being here illegally. It lets these Americans, who have successfully completed rigorous background investigations, go to school, earn a living, support their families, pay taxes and work toward achieving their dreams like the rest of us. They are called Dreamers, and regardless of where they were born, they deserve our respect as equals.
(Yep. And surely anyone who has been through all that they have been through should have no trouble following the laws of our land and becoming legal citizens.)
I’ve received several notes over the weekend from Dreamers within Apple. Some told me they came to the U.S. as young as two years old, while others recounted they don’t even remember a time they were not in this country.
Dreamers who work at Apple may have been born in Canada or Mexico, Kenya or Mongolia, but America is the only home they’ve ever known. They grew up in our cities and towns, and hold degrees from colleges across the country. They now work for Apple in 28 states.
They help customers in our retail stores. They engineer the products people love and they’re building Apple’s future as part of our R&D teams. They contribute to our company, our economy and our communities just as much as you and I do. Their dreams are our dreams.
I want to assure you that Apple will work with members of Congress from both parties to advocate for a legislative solution that provides permanent protections for all the Dreamers in our country.
(Good for you, Tim. Now how about you actually do that rather than saying you are going to do it? That’s why Congress can’t get anything done either. All blow and no go. Note, too, that this is exactly what Trump is asking them to do. So good of you to offer your support.)
We are also working closely with each of our co-workers to provide them and their families the support they need, including the advice of immigration experts.
(Awesome! Was that so hard? DACA can then become a non-issue, as I suggested above!)
On behalf of the hundreds of employees at Apple whose futures are at stake; on behalf of their colleagues and on behalf of the millions more across America who believe, as we do, in the power of dreams, we issue an urgent plea for our leaders in Washington to protect the Dreamers so their futures can never be put at risk in this way again.
(Ummmm… I believe in the power of dreams, but also that of obeying the laws of the land. The solution you stated above is perfect, and that not having been done before is what is really putting these people’s futures at stake.)
Despite this setback for our nation, I’m confident that American values will prevail and we will continue our tradition of welcoming immigrants from all nations. I’ll do whatever I can to assure this outcome.
(Yep, American laws and the processes for establishing those laws will finally now prevail. Sending folks to immigration lawyers is a great way to ensure this outcome – and to avoid this setback in the first place.)

they did prevail, the Constitution IS American values…Congress makes laws, not flunkies from the executive branch of a treasonous administration.
The Constitution is not a list of American values. It was intended to be a living document recording the rights and responsibilities of how the new nation would conduct its affairs. Ask anyone one the street what are his values and he will go on and on about his religion, his family, and his community relationships. He will seldom if ever refer to the Constitution as a daily guide, and when he does, it will be in selective snippets and often out of context.
The constitution, sadly, is being used by nefrarious factions as a political weapon. The absolutists would have it become outdated without refinement forever, the legalists would like to create excruciatingly complex (i.e., profitable) law on top of it, and blogger simpletons will refer to it as if it was a trump card in a debate, exposing their ignorance of government with every sentence.
But it is nice to finally read one of these online arguers finally admit that Trump’s administration may have committed treason. Cooperation with a foreign power in order to change an election outcome should be delt with very harshly. After all, isn’t that what you read in Section 3 of the constitution?
