“Samsung Electronics Co. was rebuffed in its request for reconsideration of whether it infringed Apple Inc.’s patented designs for smartphones,” Susan Decker reports for Bloomberg. “The U.S. Court of Appeals for the Federal Circuit in Washington on Thursday denied a petition for a rehearing in the case, which was originally decided in May. A three-judge panel at that time upheld about $548 million worth of damages won by the iPhone maker. The case will now be sent back to the trial court in California to see the full amount Samsung will have to pay.”
“The patents relate to the iPhone’s front face, overall appearance and graphical interface. Apple said the designs were critical to success of the products and that Samsung copied the Apple designs to transform ‘bulky, walkie-talkie-like boxes’ into something that mimicked the iPhone,” Decker reports. “The appeals court still has to rule on a second trial involving different Apple patents. There are two appeals in that case. One is over the underlying liability finding and a second, argued in March, is over whether Apple is entitled to an order blocking sales of some Samsung products based on the infringement finding.”
“Samsung said it was disappointed in the court’s decision and pointed to its own history of new ideas. ‘For decades, we have invested heavily in developing revolutionary innovations in the mobile industry and beyond,’ Danielle Meister Cohen, a spokeswoman for Samsung, said in an e-mailed statement,” Decker reports. “‘We are confident that our products do not infringe on Apple’s design patents, and we will continue to take appropriate measures to protect our products and our intellectual property,’ said Meister Cohen.”

Good! Now pay up, Samsung! The Supreme Court doesn’t have to accept the case if they don’t want to, so if they deny Samsung’s attempt to appeal, this is a done deal.
Who wants to bet that the amount of money Samsung has spent on lawyers and what not, trying to avoid paying the fine is turning out to be more then the fine? Hey, anything that drain’s Samsung’s coffers! If it’s not an iPhone, it’s somebody else PoS…
Having been a participant (from the edge) of a few of these kinds of lawsuits, I will say that I doubt Samsung spent more than about $20 – $30 million TOTAL on this and related suits. Yes, lawyers and litigation in general is expensive, but not $500+ million expensive.

Several firms filed a ‘friend of the court’ brief earlier this month. The list of the aforementioned companies supporting the Galaxy smartphone maker includes Google Inc (NASDAQ:GOOG), Facebook Inc (NASDAQ:FB), eBay Inc (NASDAQ:EBAY), Dell Inc. (NASDAQ:DELL), and HP.
Equally unscrupulous crap peddlers flock together.
Man, any bets on when Samsung will eventually pay up?
This is their standard MO. Delay and delay for as long as possible. I think Apple won’t see anything until the end of 2016.
Apple spent Billions on R&D to develope and patent and otherwise protect their unique intellectual property, which has clearly been a success in the market place. Samsung has been found guilty of stealing Apple IP, and making their products appear and function nearly identically, making many Billions of dollars as a result.
It would seem that $548 million is a small price to pay for many $Billions in profits. So, who really wins here? It seems to me that our patent and legal system is inadequate to protect IP in the fast paced world of high tech. This may be a moral win for Apple, but certainly not a financial win.
That is really the whole point for Samsung.
They spent very, very little on IR&D to develop the iPhone knock-offs. They sold them at significant profit for many years. Then when sued modified them just enough so subsequent models would not get included in the suit.
Samsung is money ahead for doing this, and the phones that might get banned are already obsolete. Hell, most of them have not been being sold anywhere in the world for well over a year or more.
Samsung has already made its money off of these illegal and unethical acts. While it would rather not pay a $500+ million settlement to Apple, it is not a painful issue.

These Samsung appeals keep reminding the world that Samsung copied Apple. The result of this means at least 5 million phones that would of been sold by Samsung are now being sold by Apple. 5 million phones is around $3.5B worth of product. Samsung should continue to appeal and sell more iPhones. Thanks Samsung.
