U.S. Federal Puppet Denise Cote says she’s troubled by Apple $450 million e-books settlement deal

“A U.S. judge on Thursday expressed concern over a proposed $450 million settlement of claims Apple Inc conspired with five publishers to fix e-book prices, saying its provisions could drastically reduce money paid to consumers depending on appeals,” Nate Raymond reports for Reuters. “U.S. District Judge Denise Cote in Manhattan said she found “most troubling” a clause requiring Apple to pay only $70 million if an appeals court reversed her finding that the company is liable for antitrust violations and sent it back to her for further proceedings.”

“Speaking on a teleconference, Cote questioned if that would be fair and what might happen if the appeals court reversed her ruling on a minor issue. She also took issue with the lack of any requirement for Apple to pay interest while the appeals go forward,” Raymond reports. “The size of the Apple settlement depends on the outcome of the company’s appeal of Cote’s liability finding to the 2nd U.S. Circuit Court of Appeals.”

“If Apple loses its appeal, it would pay $400 million to consumers and $50 million to the states and plaintiffs’ lawyers,” Raymond reports. “In contrast, if Apple’s appeal is successful but the 2nd Circuit returns the case to Cote for further proceedings or a new trial, the company would pay just $70 million, with $50 million for consumers. If the 2nd Circuit reversed Cote outright and ended the case, Apple would pay nothing.”

  1. She has a hard-on for Apple for some reason. She should have her finances checked, because it’s clear Apple is not guilty of fixing any prices but their percentage (already standard), and this knucklehead assigned a brutal tyrannical overseer of the order. When will their appeal get a hearing???

      1. All those folks really want is the pay and something prestigious to add to their resume for their future bosses.

        Apple could be well advised to take him in just for lobbying power and otherwise leave him ‘working from home on mysterious marketing projects and subject to a confidentiality terms’.

  3. Cote, a Bill Clinton nominee, would have difficulty figuring out how to bake cupcakes correctly. She’s one of the worst judges in the country – and that’s really saying something. She’s a cretin who’s in way, way over her head. I’ve heard whispers out of NY that she might actually be mentally retarded. She certainly has some sort of intellectual disability, that much is quite evident.

  6. She is not certain of her judgement and may have realized this some time ago. What error(s) does she believe were made and how will that effect her little demon she let loose on Apple. Maybe she is becoming concerned about losing, then having Apple go after her and that precious pet.

  7. Apple should pay anything if her decision is overturned? Call me gobsmacked. How about SHE has to pay Apple back if her decision is overturned?

    I hope someone around these parts can supply any precedence for her idea.

    1. Well, she wants to be able to hold Apple liable for plenty of cash if the appeals court reversed and sends the case back to her for further proceedings; meaning, the appeals court thinks a new trial is required.

      After this new trial, Apple court be found liable AGAIN (and probably will be, considering who the judge is), and now Judge Cote will be limited to $70M.
