Jury awards Apple $290.45 million in damages against convicted patent infringer Samsung

“A U.S. jury on Thursday awarded Apple Inc $290.45 million, or 76% of Apple’s requested amount, in a damages retrial against Samsung Electronics Co Ltd, the latest battle in global patent litigation between the two mobile giants,” Reuters reports.

Apple had requested $379.8 million, while Samsung argued that it should have to pay only $52.7 million. In August of 2012, a nine-person jury sided with Apple on its claims patent infringement against Samsung. At that time, the jury awarded Apple $1.05 billion in damages. Subsequently, Judge Lucy Koh in March ordered a new trial to recalculate some of the damages in the case, striking $450.5 million off the original judgment against Samsung.

The judgement is expected to be appealed by Samsung. yet another U.S. Apple v. Samsung patent trial is scheduled to begin in March 2014to deal with more recent devices, including Samsung’s Galaxy S3 phone and Note 2 phablet.

MacDailyNews Take: Samsung is a despicable outfit. Do not buy Samsung-branded products.

  1. Like most of the folks who posted before me, I wish the original amount had stood… but just remember, this ain’t over, It’s only the beginning… more patents, more courts and more countries… it’s just the beginning.

  2. $890 million is a little over 3% of ScamScum Electronics 2012 proit. Not completely insignificant, but if you spread out that profit loss over 3 years, it’s not anywhere near enough to make them stop. They’ll gladly pay 1% of their yearly profit to Apple. It’s cheaper than developing it on their own (if they even could). They won’t stop copying shat Apple makes until the fines are 3-4 times bigger than this.

  3. Barring a successful appeal, the Korean maker of Galaxy smartphones and tablets owes more than $800m in damages, including the award from the original verdict as well.

Here’s a reasonable article about this damages re-trial:

    http://www.theguardian.com/technology/2013/nov/21/samsung-apple-290m-patent-infringements

Abramson said the huge legal costs and big fines the two tech titans were generating also sent a clear signal to their smaller rivals.

“As they jockey for position, it defines the territory for other people. It says to other people: ‘Don’t even think about it’. If you’re thinking about getting into this market, we’re going to hit you hard coming out of the gate.”

Actually, Apple already settled with every other infringing company, such as HTC. Only Samsung was criminal and stupid enough to demand a court case against Apple. Now Samsung gets to pay. Fork it out, crooks.

As I stated many months back:
    Samsung: You are SOOOOOO screwed.
And it’s a pleasure to watch, even in slow motion. 👿

  4. The money awarded isn’t important. I’m sure apple would have preferred a global ban on Samsung products and a court order for them to do a global ad campaign apologising to apple.

    That’s the result I would’ve wanted.
