“A Samsung Electronics Co. designer can’t testify in Apple Inc.’s multibillion-dollar patent trial over mobile devices, a federal judge ruled,” Sophia Pearson reports for Bloomberg.
“Hyong Shin Park, one of the [so-called] inventors of Samsung’s F700 phone, didn’t design any of the devices at issue in the case and her testimony is of limited value in evaluating Apple’s ‘design patents in suit,’ U.S. District Judge Lucy Koh said in the ruling filed yesterday in federal court in San Jose, California,” Pearson reports. “‘The risk of undue prejudice to Apple outweighs the probative value of Ms. Park’s testimony,’ Koh said.”

Its been good seeing all the headlines for this trial, all the inside scoops from both companies that would not have been disclosed otherwise. One thing that particularly amazes me is how many whoops Sammy is taking on the chin, time and time again over a two week period. A lawyer on their bench that is not authorized to practice law, a designer who was thought to be of some help, whacked by Judge as not relevant…. and those are just a few…. cannot wait to see this case nailed shut, post any appeal request.

Samsung is trying all this crap to give them as many possible grounds for appeal as they can think of. They’re hoping that an appeals court will see one of Judge Koh’s refusals as inappropriate.
Mind you, that doesn’t mean they’ll be successful.
