Federal court rules beleaguered Dell must defend suit alleging defective notebooks

Apple Online Store“A federal appeals court reinstated on Friday a proposed class-action lawsuit accusing Dell Inc of selling defective notebook computers,” Jonathan Stempel and Gabriel Madway report for Reuters.

MacDailyNews Take: Seriously, considering that the main OS the PC box assemblers like Dell ship is Windows, aren’t they all defective, notebook and desktop alike, regardless of hardware quality or lack thereof?

Stempel and Madway continue, “A panel of the U.S. Ninth Circuit Court of Appeals in San Francisco reversed a federal district court’s 2008 dismissal of the case against the third-largest personal computer maker. That dismissal followed the plaintiffs’ refusal to comply with a district court order that their claims be arbitrated.”

“In their lawsuit, the plaintiffs alleged that Dell violated California consumer laws by selling Inspiron notebooks that had inadequate cooling systems, power supplies and motherboards,” Stempel and Madway report. “They said the defects caused their notebooks to shut down without warning, fail to boot up, or deteriorate too quickly.”

Stempel and Madway report, “In Friday’s ruling, Judge Lyle Strom said the district court abused its discretion in dismissing the case and ‘the public’s interest in a resolution on the merits weighed strongly’ in favor of letting the case continue.”

  1. Thing that gets me about DELLs is that even if you have a specific laptop, they need to know the special code on the bottom to figure out what parts they were putting in that day.

  2. A sideline to this story: Steve Ballmer has been offered the opportunity to head up Toyota! They want someone who can sell product that runs off on its own and crashes. Apparently they feel Ballmer has the most experience in that area.

  3. Don’t some of the Dell’s run Linux? Or has that regressed to a “user-installed option” again? I can’t keep track. Not that it’s that important, but it could make a difference.
    One of the reasons the OS isn’t that important is because we are, after all, talking about Dell, which doesn’t need any assistance, thank you, from MSFT or any other provider to market a Piece ‘o Crud excuse for a computer.

  9. It died shortly after purchase, and months later no resolution—so much for service. I can’e be sure heat or faulty power supplies are connected, but I know it fails to boot!

    But they couldn’t afford more than $600 and they needed mobility.

    Before long they could have gotten an iPad and saved $100! (They already had a desktop.)

  11. Toyota now manufactures 10 vehicles in North America: the Avalon, Camry, Corolla, Matrix, Sequoia, Sienna, Solara, Tacoma, Tundra, and Lexus RX330. & Production of the Camry Hybrid

    So yeah, the Administration “raking them over the coals” is about as brilliant as the POTUS continually bagging on Las Vegas affecting their economy. Same net result, destructive to the economy, and potential loss of jobs in those plants as people stop buying the product them make.

    Brilliant if your goal is the further destabilization of America I guess…
