“The Mac clone maker that’s been battling Apple for more than a year in federal court last week asked a judge to rule that its business is legitimate, and to stop Apple from saying different,” Gregg Keizer reports for Computerworld.
“In an amended complaint submitted last Thursday, Psystar asked U.S. District Court Judge William Hoeveler to rule that it is legally allowed to sell machines with Apple’s Mac OS X 10.6, aka Snow Leopard, pre-installed,” Keizer reports.
“‘A declaration by this Court of the legal rights of Apple and Psystar with respect to Psystar computers running Mac OS X Snow Leopard would clarify, to put it bluntly, the legality of Psystar’s business — and would remove the substantial negative effect on Psystar’s business of continued uncertainty and legal wrangling between Apple and Psystar,’ the Florida clone maker said in the revised complaint filed in Miami, Fla. federal court,” Keizer reports.
“Psystar wants Hoeveler to make Apple stop saying that it’s illegal for Psystar to purchase Snow Leopard on the open market, then use those copies to install the operating system on the computers it sells,” Keizer reports.

WOW. The judge better come down hard on these lawyers. They are starting to make a mockery of the judicial system and wasting time that the judge could be using on “real” trials.
Maybe Psystar is running outa cash and needs things done before they legally can be.
Apple could fix a lot of this by selling SL as an Upgrade and have A version available on its online store for Authorized OEMs at $10,000 per license as they \ no one but Apple is authorized they would be in the wrong end of story.
The fact that the judge is even entertaining this infantile garbage instead of throwing the book at Pystar, is a mockery and a dumbing down of the entire judicial system.
This judge had better shit or get off the pot fast before history sights this case as the culprit that ended all rhyme and reason.

Yup, and if your customers have a problem you can direct them to their nearest Ferrari dealership. The customers are then free to bitch at how awful Ferrari engines are.

Actually Ferrari may not have a problem with that. It all depends what kind of a contract you agree to when you buy the engine. But you’re not going to get the engine for the $29 upgrade price for upgrading the engine in your existing Ferrari. You’re going to pay the full price of the engine. Probably $50,000 to $100,000.
Again, it seems like they will do whatever it takes to push the point forward and harass Apple in order to attack their business model, even if it means insanity.
There is no other industry where Operating Systems can be swapped around on various hardware from different corporations. It’s just a byproduct of Microsoft keeping the box assemblers subservient and helpless without their own OS. It’s not how things are meant to work. It’s not how the computer industry started.
Steve Jobs knows this, and that’s why he keeps hardware and software tied together. It creates a superior product. And Psystar knows this too, and that’s why they are trying to break Apple’s model.
