Ballmer ordered to testify in ‘Vista Capable’ class-action lawsuit

“A federal judge ordered Microsoft CEO Steve Ballmer to testify in a class-action lawsuit revolving around Microsoft’s marketing prior to the launch of its Windows Vista operating system,” Joseph Tartakoff reports for The Seattle Post-Intelligencer.

“Plaintiffs allege that Microsoft misled consumers by allowing PCs makers to designate PCs running Windows XP as “Vista Capable” even when they could only run a basic version of Vista,” Tartakoff reports.

“Microsoft had opposed plaintiffs’ motion asking that Ballmer testify, saying that other Microsoft executives had made the key decisions in the ‘Vista Capable’ program,” Tartakoff reports. “But in her ruling (read it here, PDF), Judge Marsha Pechman said Friday that plaintiffs had shown that Ballmer may have had unique knowledge.”

Tartakoff reports, “Ballmer must testify in the next 30 days for a maximum of three hours.”

  3. Unfortunately for my wife and I, our machines probably will NOT run Snow Leopard. We have a PowerMac G5 (64 bit, non iNtel) and the first gen MacBooks (dual core, 32 bit only). All great computers.

    Disappointing for us but we know that technology marches on and the line must be drawn somewhere. Since the machines do not stop working whenever Snow Leopard is released, we’ll be good.

  4. As with Lurker_PCV, my Imac G5 won’t run Snow Leopard and at least Apple didn’t try to convince me that it would. Let’s get Ballmer’s fat butt in front of a judge and jury at some point and see if he’ll lie thru his teeth or use some fancy semantics to convince people that MS wasn’t being deceptive.

  5. Anybody have tickets? I’m willing to pay top dollar to see the master lay the smackdown on the crybabies who whine about Vista. And that also goes for you smug MAC sissies who think you’re so superior with your cobbled together 30-year old toy operating system.

    These little girls just don’t get it. The awesome thing about Vista is you have choice. You can put up to 7 flavors of the latest version of magnificent Windows on countless variations of hardware at multiple price points. You MAC lemmings have no idea. Give it to ’em Steve. Never surrender!

    I really am a PC but I use a PowerMac and a MacBook as my computers. (I so want to submit an “ad” like that to Microsoft.) How about you – the REAL you – not the ZT persona?

    Side note – my 6th grade teacher always use to say, “Stop being a PC! Of course she meant a Public Clown. I always wanted her to say that to me; she never did. I suppose I should carried on more.

  8. It will be interesting to see how Ballmer’s confession, uh testimony will compare to Bill Gates during the antitrust case.

    By the way ZT when Bill Gates went to court on the antitrust case, his “smackdown” contributed to Microsoft being convicted of an abusive monopolist.

    The judge got it then, most likely it will happen again.

  9. Can he get by without perjuring himself? It amounts to how much time he has to unlearn all that he learned since leaving college… years and years of doublespeaking means he’s in deep doodoo. The quotes that’ll come out of this will be MDN fodder for years.
