Apple offers $50 credit for iPod batteries to settle class-action lawsuit

"Consumers who had battery problems with older versions of the popular iPod digital music player will get $50 vouchers and extended service warranties under a tentative settlement in a class-action lawsuit," Rachel Konrad reports for The Associated Press.

"Lawyers representing consumers in the state court case against Apple Computer Inc. said Thursday that the settlement could affect as many as 2 million people nationwide who purchased first-, second- and third-generation iPods through May 2004. Cupertino-based Apple confirmed the settlement but deferred immediate comment," Konrad reports. "A judge in California's Superior Court for San Mateo County initially approved the settlement last month and consumers began receiving notifications by e-mail and letters this week. A judge will hold another hearing Aug. 25 to give final approval. 'We think all the terms of the settlement are going to stick,' said Eric H. Gibbs, a partner at San Francisco-based law firm Girard Gibbs & De Bartolomeo LLP, which represented several plaintiffs."

Jung, a few words for you: READ THE F*CKING ARTICLE. Apple is not taking a $100M hit. They are taking a little over $2 million hit to the lawyers. As far as consumers, what they get is a one year extension of the iPod warranty for the battery. The $50 mentioned is not cash in anyone's pocket--it is $50 off the purchase of another Apple product, and iTunes music store purchases are excluded. Meaning you can't even turn in your voucher for 50 songs.

Upshot? Apple pays out $2 million to the lawyers, fixes a few dozen iPods, and whatever consumers bother to apply for vouchers get $50 off their next generation iPod, OS X 10.5, or whatever. That's the way these class action things usually end--the consumer only gets a savings by buying more from the company being sued, so the suit ends up being nothing more than repeat customer encouragement.

Apple makes a suck as product for its product...but to the Apple-is-god religious freaks here that´s okay.
If it was microsoft or dell, the apple widget heads would be screaming their heads off at the incompetence of those companies.
No wonder apple isn´t worried about this....most apple people won´t take advantage of it because that would mean they are admitting apple makes flawed products.

I wonder if Apple will apply this policy world-wide or just in the U.S. where they are being forced to? My iPod fits the class action suit, but I am in Canada. If they were serious about owning up to a problem, they will hopefully apply this evrywhere.

I wonder if this applies to my 2nd generation iPod that I purchased through the Apple Online Store in Feb 2003 that was a "refurbished" iPod.

Does that qualify as being new? I've read the details a couple times, but cannot find anything about it in there.
