Attention Apple Legal Dept: ABOSS I-Pocket rips off iPod mini in spectacular fashion
Wednesday, December 22, 2004 - 04:13 PM EDT

Introducing the ABOSS i-Pocket, a completely transparent attempt to create a facsimile of Apple's iPod mini portable music player. Throwing in the 3G iPod's four buttons above the scroll-wheel design and coming in the exact same five colors as the Apple iPod mini, ABOSS is practically demanding a lawsuit from Cupertino.

The device's mimicry stops at its screen, which is a color OLED and also accepts SD/MMC/Memory Stick cards into its built-in card slot. The ABOSS i-Pocket supports USB2.0 and claims to support eight languages.

The ABOSS i-Pocket's "scroll wheel" isn't really a wheel at all, seems it's just meant to look like one. It doesn't turn at all and instead consists of four buttons that control volume (up and down) and track skipping (back and forward).

Not since eMachines threw the original iMac into a blender and spat out the eOne, has such a blatant attempt at copying an Apple product come to fruition. The result of that bold attempt was a prompt lawsuit from Apple and eMachines having to discontinue production of the eOne after they lost in court.

We bet Apple's lawyers, already a busy lot, have this i-Pocket piece squarely in their sights.

It's different enough not to be a legal problem. It will never make it to the U.S. however, as many other far east players don't. No problem.

3rd post!

Dec 22, 04 - 05:58 pm Comment from: atomic flower

i agree with pkradd... the key to the apple design is the scroll wheel.

interesting to see what happens, though.

I wonder if the "flip phone" was ever trademarked?

All I can say is WOW... some people are just without ethics...

Sic 'em Apple

Dec 22, 04 - 06:12 pm Comment from: Fred Mertz

pkradd,

I think you are wrong on this. The eMachines eOne was more different than the iMac it tried to copy and they lost big time. This thing is way too close to the iPod mini - it's obvious. They'll lose, too, if Apple sues.

Dec 22, 04 - 06:15 pm Comment from: NewType

Wrong - just because it has some different functionality doesn't mean the company gets off scot-free. The look and feel of a product can be the sole basis of a lawsuit, never mind the functionality. eMachines argued that the eOne was also "different' because it had a floppy drive and parallel ports, which the iMac didn't have. The courts shut the eOne down pretty fast.

The question is whether the look of "I-Pocket" is similar enough to the iPod that it causes confusion in the minds of the average consumer. It doesn't matter that the "I-Pocket" will never make it to the U.S. - Apple will go after the company to protect the iPod, which is a worldwide brand.

I'm buying 10 of em. Make a fortune on eBay after the lawsuit.

Dec 22, 04 - 06:54 pm Comment from: Benn

Looks nice - if they are cheaper than the iPod I want one!

Dec 22, 04 - 07:12 pm Comment from: John

Rip Off! Even the whole shape of the body is an exact copy of Apple's mini. Lawsuit is definitely in order here. The shouldn't be so blatent about coping Apple when they make a product.

Dec 22, 04 - 07:21 pm Comment from: what's inside?

Checked the link, but there's not enough engrish to make anything out. Does it even have an HD, or is it just removeable flash-based? Not that that should make a difference in a lawsuit...just curious.

Dec 22, 04 - 07:28 pm Comment from: gRen

Is it a Chinese product? If so wouldn't it be hard to go after them considering their lack of copyright laws? Just wondering.
It's funny that no matter how close they get, they still don't get it. If you're going to get this close to the original, you might as well clone the damn thing. Either was Apple will try to shut you down.

Yeah, NewType is right. This is an obvious rip-off.

Isn't entirely true.

How about his 'G5' currently on sale in the UK

I just received publicity materials advertising the first of these listed below for wholesale distribution. A quick web search shows that there are more blatant iPod copies on their way from China. Apple needs not just to sue, but to grab this market quickly.

What so different about this company than any other company example Creative Labs ... majority of the new mp3 player look somewhat like the iPod .. Creative is even trying to copy the iPod interface.

Dec 22, 04 - 11:55 pm Comment from: mike

WOw.. that Digital Village PC is BUTT UGLY..

where the hell do you guys find this stuff.. amazing...

Ripoffs work in CLothing generally.. but in this case.. they picked the wrong product to ripoff..

If people expect iPod-like seamless integration and accidentally buy one of these things.. thinking it's an iPod.. they will tell all their friends ABOSS is shite.. you won't see this thing for long.. same goes for any other ripoffs..

They might even get slapped with false advertising for implying that it's an Apple product.. who knows...

Dec 23, 04 - 01:12 am Comment from: Hellstudios

Look at it from the other direction: maybe they'll take some market from the other mp3 players. There's no way there'd be an iPod within coo-wee of a second rate joint selling these - only other second rate players.

We all know what Oscar Wilde said about imitation.

Dec 23, 04 - 10:33 am Comment from: Al

Sure looks like they get the outer case from the same source as Apple. Seconds maybe.

Dec 23, 04 - 11:31 am Comment from: giofoto

Even if its a rip off.....people will want the REAL THING! in the end. They will never EVER have that same satisfaction of having the real thing....especially when someone around has one...they will just hide it in shame wishing they had the real thing. That urge will be strong so, they will eventually get the REAL THING! The numbers on the rip off will be low.

Dec 23, 04 - 11:59 am Comment from: Herbie

imitation is flattery

Dec 23, 04 - 03:20 pm Comment from: Gary

The problem here is that the iPod is such a wild success more due its look and feel, not its technology (even though no one has been able to duplicate its ease of use). So, when you are making a product that is clearly an attempt to confuse consumers by copying look and feel, you are begging for lawsuit.

And they will get it.
