Would-be ‘Mac cloner’ Psystar files for Chapter 11 bankruptcy; temporarily stalls Apple’s case

"Unauthorized Mac clone maker Psystar has filed for Chapter 11 bankruptcy protection in Florida, temporarily slowing down Apple's legal case against it. The filing may be an indication that the company's financial backers have pulled out, signaling they see Apple as the clear winner in court," Jeff Gamet reports for The Mac Observer.

"The bankruptcy documents were filed with the Federal Courts in Florida on Thursday... The Florida court will hold a hearing on June 5 where Psystar's equity creditors will be revealed -- which means if there have been deep pockets behind the company's fight against Apple, those names will finally come out of the shadows," Gamet reports.

"Psystar's bankruptcy filing will temporarily slow down Apple's case in northern California because all legal actions involving the PC maker are automatically put on hold while the bankruptcy court begins its proceedings," Gamet reports. "The judge overseeing the case will, however, most likely lift that stay within a few months, allowing Apple's case to start moving forward again."

I wonder how much support he expect to receive from them now... I guess he got exactly what he paid for.

Hopefully those staunch Psystar defenders will be along to explain why buying ugly PC knock-offs from a fly-by-night company is a better long-term investment than paying the extra money to buy a well-designed, well-supported machine from Apple instead.

I have a feeling that those financial "friends" of Psystar will somehow remain untouchable and anonymous, even with the bankruptcy proceedings. The owners of the business may end up in contempt of court, or charged for improper bookkeeping or something of that nature, as it seems that they were already unable to produce any meaningful documentation regarding their sales and other financials. These guys simply didn't have a clue how a business should be run. They'll end up losing everything they made and possibly (actually, likely) even do time.

Even if they ever did, they no longer do. I wonder, though, if the next Leopard update breaks your OS, what will happen. Normally, I'd call Apple, but I have a real Mac; you won't have anyone to call. Therefore, you'll have to be wasting your own time for that. I don't know what amount of money you make, but if I were a Psystar owner, in two hours of tinkering with the kernel in order to make it work again, I'd probably have lost more money not earned than what the computer was worth when I bought it.

Then again, you may be working the McDonalds counter, so your time is relatively cheaper; you'd have to waste entire workday on fixing that Psystar before it becomes more expensive than a real Mac.

The "Shyster" guys may think they're going to thumb their noses at Apple with the bankruptcy. What they did, though, is bought themselves just a few weeks' worth of time before it resumes, and resume it will, and quickly. Only this time, much more will be revealed, due to the bankruptcy proceedings. A fitting end to a way too long saga.

In over 20 years of owning a Mac, I've only updated the OS ONE time, (System 7.5). So I dont worry about your pathetic scenario. My top notch, high quality Psystar hardware is good to go for the duration.

I'll get the new version of OS X when I need a new mac, and not before. Psystar, or some other company will be around filling my hardware needs that Apple refuses to make.

Leopard had 7 major updates since it came out (about 18 months ago) and several other security fixes. Unless that hardware of yours is located at an isolated island in Pacific, without a network connection, you simply must update the OS whenever the update is available. To not do that is simply foolish.

Apparently, Apple is quite capable of filling hardware needs of literally all Mac users out there (the minuscule number of Psystar users notwithstanding). All you need is the appropriate amount of cash (or equivalent financial instrument).

Mac is a hardware and software platform.

You know who spends all their time trying to get the right things, do the right things? Criminals. They could work and get paid, but instead they will go out of their way to scheme and plan and basically waste their time and jeopardize their future.

Pystar is for tinkerers. And for that matter, if you want to Tinker, just buy some PC parts and build a PC even cheaper than a Pystar. What a joke. No value, no innovation, and now, no more company. Wake up and smell the roses. The hardware/software platform is back with a vengeance. People want things that, well, just work. They dont want stuff thats cobbled together from two bit hacks who cant make a legit living, so they try and build "mac"-compatible PCs. What a joke. Is this what our culture is about? Don't innovate? Don't create? Eveyone for themselves in a mad dash for cash? Sad.

I used to work at Pystar until 3 months ago. I was laid off. Our PCs are just really basic with ultra cheap cases. Nothing special. Our sales have not been good because we would not pay our parts distributors. They had us on credit card terms and my bosses ran out of money. The whole thing started basically in an apartment and then within a day or two of getting publicity, we were quickly moved into an office building of sorts. It was all for show. There was really nothing behind our website. Just some bare bones PCs put together by a couple people with limited skills. Not sure why this became so important to the public, but anyways, thats the story. And I am not rattymouse.

In a way, Psystar was no different than those Russian warez sites. You pay some $30 or so, they let you download Adobe Photoshop. You could have probably downloaded the same file for free from those file sharing / bit torrent places, and it would have been just as illegal.

Much like the hackintosh movement; you can either build your own, or pay someone to build it for you. In the end, it steals the IP from Apple just the same.

I used to work at Pystar too. We had one customer: rattymouse. He bought 2 PCs and then called to complain about his rinky dinky parts failures on a daily basis. What did he expect? we sold junk and he bought into it hook, line and sinker. As if other companies will "meet his needs" when Pystar is down for the count? What needs? Of selling junk or being illegal? Rattymouse is a rat all right, and a dirty one at that. Cheers

Possibly it did. I had no difficulty figuring it out. But if you are going to chide people for their English, make sure yours is good. For one thing, it would be "...could have set up..." ("setup" is a noun. "set up" is a verb form.) Second, "...what the sentence means..." is one of several possibilities. Your way is wrong.

If Apple made a desktop Mac that didnt have a monitor attached to it, I'd buy it in a heart beat. Apple doesnt so I gave my money to Psystar. Now I have TWO top notch, high quality desktops. Poor Apple, they had me then they lost me.

And you can forget about the Mac Mini or Mac Pro. NOT AN OPTION.

Absolutely nothing wrong with Mac mini. Getting Shyster hardware instead of the Mini is simply rationalising something that is essentially theft. They aren't really all that different, performance-wise, as much as you would want to make yourself believe that they are.

There really is no valid excuse for buying any kind of computer for Psystar (make that: "there really was..."; no more anyway).

These fly-by-night operators will probably pop up here and there every once in a while. If Psystar saga is any indication, they won't last long.

If you don't like any of Apple's offerings, you can always slap some Linux distro on some generic hardware (if you so hate Windows). Vote with your dollars. And no, IP theft doesn't count.

We may NEVER know who, if anyone, helped bankroll Psystar's defense case against Apple. In filing for bankruptcy Psystar has more or less conceded defeat and this may lessen the desire for Apple to continue the case since pursuing it would mean that Apple will get only pennies on the dollar from Psystar and even higher legal bills if it continues to pursue the case to the end. This almost seems like a sleezy conspiracy with some unknown corporate rival(s) to take the case as far as possible just to make Apple pay as much money in legal bills. It wouldn't surprise me if Apple and Psystar were to cut a deal before June 5th outlining how much Apple will get in damages in exchange for NOT publicly releasing who, if anyone, colluded with Psystar in this legal case.

You are insane. The Mac Mini is NOT an option. I need MORE than 2.0 Ghz and need at least 500 gigs of internal storage that spins at 7200 RPMs. My Psystar systems cost only slightly more than the Mac Mini's and DESTROY them in terms of performance.
