Woz to walk ‘Dancing With The Stars’ partner Karina Smirnoff down aisle; Also: Vote for Woz tonight

"He's a computer genius, he dances and now folks – he does weddings," Lauren Johnson reports for The New York Daily News.

"Apple magnate Steve Wozniak has gotten super chummy with his 'Dancing with the Stars' partner Karina Smirnoff, and it looks like he may play a key role in her upcoming wedding to pro dancer Maksim Chmerkovskiy," Johnson reports. "'She said I could walk her down the aisle, and it touched my heart,' Wozniak recently told The Insider."

Johnson reports, "Of course being able to make that walk depends on how well he heels from injuries he's sustained throughout competition on the show. Wozniak is nursing a fractured foot and a pulled hamstring."

The perfect ironclad prenuptial agreement


There are certain crucial elements that go into creating an ironclad prenuptial agreement. Depending on the complexity of the assets involved, a prenup does not have to cost too much but it will almost certainly cost less than a divorce. It is also important to bear in mind that while the courts almost always tend to rule in favor of prenups, even in cases of adultery or domestic violence, they also employ a "smell-test:" If the court determines that one of the elements of a set aside exists, or your spouse can demonstrate gross unfairness, it will rule against you.

Be sure that both parties have legal representation when drawing up a prenup. If your spouse does not have his/her own attorney, in the event of a divorce there may be grounds for setting aside any premarital agreement.

--Any binding prenup must be witnessed by an attorney or a notary. It is not enough to shake hands on a prenup, let alone sign it yourselves. It may all seem like so much litigious formality at the time but if the worst happens, you'll find that it won't stand up in court.

--Full financial disclosure is imperative. Remember, asking for a prenup is tantamount to telling your future spouse you don't trust them. Don't give them any ammunition by being deceitful yourself. Raoul Felder suggests that you should overstate your net worth by at least ten percent. Although that may seem reckless, if there is any appearance of fraud, even if it is an honest mistake, your spouse's lawyers will pounce on it and the court will rule against you.

--Prenups should be free of any hint of duress so, unpleasant though it may be in the full bloom of love, if you are planning on asking for a prenup get it over with as soon as possible. "Once the invitations have been sent out, the hall has been hired and the menu chosen and the wedding's a week away, that's no time to sign a prenup," says Felder. "It is very difficult to say no at this point and a court will take that into account in case of divorce."

--Undue influence must also be avoided. It cannot appear that your spouse had no choice in signing a prenup. "Sign this prenup or I'll fire your brother," is no way to hold on to your money.

--Another no-no is unconscionability. If your spouse has no assets of their own, you cannot leave them destitute. It is illegal for the court to go against public policy (i.e., placing your wife on public assistance) and it is likely to rule against you.

--Every good prenup should clearly define what is marital property and what is separate property . Different states have different definitions of what constitutes one or the other. For example, New York is a non-title state, meaning that a home bought during the marriage automatically becomes marital property even if only one of the spouses physically paid for it. (New York State law rules in favor of equitable distribution in most divorce cases.) The distinction between the two can become very fine and is the kind of thing that can occupy lawyers very happily for years so make sure the prenup is very clear about what is what.

--Some prenups explicitly state that the signee waives all rights to all monies other than those stipulated in the agreement. Many, however, do not. It is common to have one partner thinking they have an ironclad prenup only to learn that the other still has claims to maintenance, estate rights, child support and, ironically, legal fees.

--Any good matrimonial attorney will also advise you to include a "triggering event" which would automatically initiate divorce proceedings and would distinguish between marital and separate property as of that date. (The event can be as simple as a registered letter.) This can be invaluable, particularly if your prenup is based on providing your spouse with a percentage of your wealth and you are expecting any future earnings, inheritance or other monies.

--Avoid bizarre or unreasonable demands. Don't stipulate that your children have to be raised as circus clowns or that your spouse has to wear nothing but spandex body stockings. Any judge will throw it right out of court.

--Just because you've done everything correctly, don't think that your spouse still can't put the screws to you. In New York state, for example, anyone who signs a prenup has six years from the time the agreement is signed to contest its terms.
