EU court rejects U.S. government intervention in Apple’s Irish $15 billion tax case

“Europe’s second-highest court has rejected a request from the U.S. government to intervene in Apple’s challenge against an EU order to pay back taxes of up to 13 billion euros ($15.3 billion) because it failed to prove a direct interest in the outcome of the case,” Reuters reports.

“”Apple, maker of the iPhone, appealed to the Luxembourg-based General Court a year ago after the European Commission ruled that its ‘sweetheart’ tax deal with Ireland was an illegal subsidy in breach of EU rules against unfair competition,” Reuters reports. “The then Obama administration had criticized the EU decision, saying the EU was helping itself to cash that should have ended up in the United States.”

“The U.S. intervention was filed in April,” Reuters reports. “The court said it was unconvinced by the U.S. arguments regarding the alleged negative effects of the EU decision on its tax revenues, the bilateral tax deals with EU countries and its efforts to develop rules on transfer pricing in line with OECD rules.”

    1. Apple got preferential treatment by Ireland, which obviously runs afoul of the EU tax code, as it should.

      Stop making excuses for a corporation. Apple doesn’t care about you, they want your money.

  1. This is why these corporation need to pay a higher tax, because they have the US government working on their behalf in their overseas disputes.

    How many regular tax paying citizens get the clout of the government of the United States involved in their tax disputes with other nations, not to mention the help with trade, and the use of the court systems. They sue each other every other day.

    These companies, Apple included, should be happy to pay those taxes at the higher rate. These companies certainly use more the government resources then they would claim to.

    By the way, did you guys see the trump voter on CNN.com, poor man, he says trump just lies so much. See, I told you. When people think donald trump, they think lie. The russians must have something on this guy for real. The other day the US military had to dissuade russian fighter aircraft away by launching flares and trump calls putin to thank him for saying something nice about him today… DUDE THE RUSSIAN MUST HAVE SOMETHING ON THIS GUY. We are almost in a shooting war with the russians and calls putin to thank him… SOMETHING IS UP.

    You can still be cheering for your favorite team if you want to, but you better open your eyes and see before you have to learn to speak russian. Let’s be clear, the rich enjoy a great life style no matter what form of government they are under. Don’t kid yourself.

    Haha, $15B of taxes not going to the US Treasury is not a “direct interest”? Fancy that.

  4. @ KenC except.. that money was not going to the US as Apple chose not to bring the money over to the US and pay tax there either.
    Being that US government never did anything about it, it’s considered that it wasn’t interested in it.
