Italy’s proposed law against Apple’s ‘walled garden’ sparks fears of iPhone ban

“Italian newspaper Corriere della Sera published a headline today that translates to “‘the bill that could ban the iPhone in Italy,'” Joe Rossignol reports for MacRumors. “”

“The bill in question, Senate Act 2484, is aimed at ensuring Italians have open access to software, content, and services,” Rossignol reports. “The portion of the bill potentially relevant to Apple essentially says that users should have the right to download any software, whether proprietary or open source, on any platform.”

“The bill was introduced last year by Stefano Quintarelli, an Italian entrepreneur and member of the Scelta Civica political party in Italy,” Rossignol reports. “The bill was approved by the Chamber of Deputies in July 2016, and it now must be approved by the Senate of the Republic, within Italy’s parliamentary government.”

Trying to grasp the desktop concept, waiting for things to load…. or maybe coming in one monday and Mike says we got a new computer. An Apple III. Came dead so I did the Sol Drop Test and it started up. Sold one later that morning.

We’d spend a few days at my second floor victorian place in Eureka… a few days at her cabin overlooking big lagoon, north of Trinidad, WA. A drafty cabin, cold with northwest nights, crisp and cold. It was a drafty cabin too. I learned to be natural then. Eating granola bars and checking mucus at 4:30 in the morning for birth control. Do a search for big lagoon. Look at the images. The ones from the north looking south… that was my view…

    1. Apple could “easily” get around this by letting users sideload apps via Xcode and a developer’s account. That’d ensure the code being loaded is open and available for scrutiny, and limits the vector for malware to those with some level of technical ability (or someone that provides such services, but shady ones can still be traced through the signed developer certificate).

      They already did exactly this a couple years ago, but then they greatly reduced the time that the sideloaded app would work for, from a year to a mere 7 days.

      1. I’m pretty sure that Linux was built off of UNIX, which was created in the 1970s by ATT, which is an American company. Later on, California computer scientist and Free Software advocate Richard Stallman came up with GNU. Not to mention that Linus Torvalds is a naturalized American. The framework for GNU/Linux was built in the US, and was later worked on in Finland. YOU are the one who should get educated.

  1. I’d like to point out that the “politician”, Stefano Quintarelli, is really a technologist person, and was instrumental to bring Internet to Italy in the very early 1990′. He is not someone who is “ignorant”: it is rather you, who wrote that phrase, that are ignorant of who he is.

    Of course he’s a ‘open software’ person, a position we do not all agree with (myself included).
    But I cannot accept an insult done without first trying to dig down a bit.

      surely ONE ( supposedly) ‘closed’ system which is curated and more safe against malware actually BROADENS the options?

      I say iPhone is ‘ supposedly’ closed as it is actually open to all kinds of stuff (devices to be linked to it), software etc. Except Apple supervises it all and has responsibility

      Not to mention if Apple has to deal with all the idiots ignorantly downloading virus ridden, crappy ‘open’ etc software Apple would have to deal with complaints etc (” the iPhone is Broke”) etc — RAISING the COSTS for Apple which would be PASSED DOWN TO THE REST OF US.

      Google gives Android FREELY to avoid having legal issues when crap happens to Android on Phones . (They then make money by spying and selling info to advertisers via Android search , maps etc. )

      Recently I had a bunch of suspicious emails from my wife’s friend, then we found out her ANDROID phone had been hacked and she lost a lot of her personal info. If we had opened her email’s we would have had our computers infected … We DON”T NEED ‘OPEN” CROCK for iPhones…

  2. This is typical of the way technology is going in the EU ironically its own version of a walled garden but this one is potentially very debilitating and damaging to what is already a continent falling behind the world leaders in cutting edge technology and innovation.

      I suppose their answer might be that they *can* download them; they just won’t run. But still, I like your argument!

If you read the source article the bill appears to have a clause specifying:”Users have the right to, in an appropriate format to the required technology platform […] use fair and non-discriminatory software, proprietary or open source […] content and services of their choice.” I take this to mean that Android is ‘safe’ from the bill since it appears to target the ability to obtain software that is compatible for your device from ‘other’ sources/App stores.

  3. Why does every change seem to target Apple directly? Italy would prefer to have a fragmented, relatively insecure platform like Android, so they would try to ban iOS. Exactly who is asking for this? The average smartphone user in Italy? Because Apple is vetting the apps in the App Store, I would think those apps would be much safer for the average consumer to use. There must be some Italian consumers who would prefer a “walled garden” when it comes to smartphone security.

      2. As a European I do have to point out that a lot of tech comes from here – just as much as the rest of the world. The TV, telephone and Microchip were invented where I come from. Oh and ARM and the GPU IP that the iPhone uses? I’m not being anti-American but please realise the big guys aquire lots and lots of Euro companies, euro IP and hire Euro personal. Think Jony Ive for example? Please wake up and stop being so ignorant that America invents everything!

We have long been conditioned to think precisely that, — because for well over a hundred years many of America’s brightest and most consequential scientists were either driven out of Europe, or fled lassitude and neglect by its decadent aristocracies. Italians Guglielmo Marconi and Enrico Fermi spring to mind. They came up with radio and atomic power. We also enjoyed the talents of Hungarians John von Neumann, Leo Szilard, and Edward Teller. Poland contributed Stanislaus Ulam, Austria Kurt Gödel, and Germany blessed us with Charles Steinmetz, Emmy Noether and Albert Einstein. Nicola Tesla, formerly of Serbia, might have been our very brightest immigrant.

          Some of today’s tech does come out of Europe – the LHC is impressive, and you lot did manage to land on a comet. It’s too bad you wasted a hundred years on military adventures and fox-hunting.

      1. Actually, I’m well known for NOT talking too much. Instead, I typically take mass quantities of tech complexity and distill it down to focal points and action points. IOW: You’re from the wrong side of the Currie tracks. That’s not your fault.

If we both ran a marathon I wouldn’t expect us both to cross the finish line at the same time. However if I did win, I wouldn’t feel the need to go on and on and on and on about it like you do.
