Apple asks U.S. Supreme Court to rule against Samsung for infringing iPhone patents

“Apple Inc on Friday asked the U.S. Supreme Court to rule against Samsung Electronics Co Ltd over whether Apple should receive damages in a case about smartphone design patents,” Dan Levine reports for Reuters.

“The world’s top smartphone rivals have been feuding over patents since 2011, when Apple sued Samsung in a northern California court, alleging infringement of the iPhone’s patents, designs and trademarked appearance,” Levine reports. “Following a 2012 jury trial, Samsung was ordered to pay Apple $930 million. Samsung has been trying to reduce that figure ever since.”

Levine reports that Samsung’s “efforts were partially rewarded in May 2015, when the U.S. Court of Appeals for the Federal Circuit reversed the trademark liability, bringing Samsung’s exposure down to $548 million.”

MacDailyNews Take: We hold out very little hope that Apple to ever receive even a modicum of justice over the rampant theft of many of their iPhone and iPad innovations.

The fact is that the main reason why Samsung et al. were able to sell phones and tablets at all was because they made fake iPhones and fake iPads designed to fool the unwitting (who are now finally waking up in droves, by the way, and upgrading to iPhones in ever-increasing numbers) in much the same way as how Microsoft et al. profited wildly from upside-down and backwards fake Macs at the end of the 20th century. Google, Samsung, HTC, Xiaomi, et al. are the Microsofts, HPs, Dells, and eMachines of the new century.

      1. And suck-seeding! I’m about to enter the yawning Ignore Zone, the only way to effectively combat Internet outcasts and pariahs like Frank. They get bored when no one pays them any attention and eventually leave.

Actually, MDN, you should recall that Samsung *has* paid Apple a significant fraction of that $548 million, however that payment came with several conditions–the most significant of which is that Samsung will keep fighting this case and if Samsung eventually wins any reduction in Apple’s award then Apple needs to give money back to Samsung.

    So…
    If Samsung wins at the Supreme Court, Apple will have to give all monies back to Samsung. Thus, it is possible that Apple will have spent millions on this lawsuit and end up with nothing but lawyer bills while Samsung walks away with it’s ill gotten installed base and customer base.

  3. I dream that:

    SCOTUS not only reinstates the $930 million, but tacks on an extra $1 Billion for wasting the time of the US court system and that of Apple. PLUS Samsung has to pay all court fees. AND Scamscum is scolded to never abuse the US court system again or they will acquire further penalty fees. THEN back home in South Korea, Gregory Lee is pied in public by one of his company’s stockholders. Lee is then found the next day raving and drooling in a corner of office. He’s shipped off the loony bin, marking the day Samsung turned around its self-destructive work culture, making it into one of the truly inventive and collaborative companies of the world.

    It could happen! 😉
