Samsung to fight Apple smartphone trial verdict, lawyer says

“Samsung Electronics Co. will challenge a jury’s $120 million award to Apple Inc. in a patent-infringement verdict that was ‘unsupported by evidence,’ a lawyer for the Suwon, South Korea-based company said,” Joel Rosenblatt reports for Bloomberg.

“Samsung will ask the trial judge and an appeals court, if necessary, to reduce the damages awarded by the jury May 2 and yesterday to zero, John Quinn, a lawyer for the maker of Galaxy smartphones, said in a statement,” Rosenblatt reports. “Apple sought as much as $2.2 billion in damages in the companies’ second U.S. trial as the world’s top two smartphone makers seek to dominate a market that was valued at $338.2 billion last year, according to data compiled by Bloomberg.”

Rosenblatt reports, “Samsung had 31 percent of industry revenue, compared with 15 percent for Apple, whose share of the market has shrunk as the touch-screen interface has become more commonplace and Samsung, LG Electronics Inc. and Lenovo Group Ltd. have introduced lower-cost alternatives.”

MacDailyNews Take: Bzzzt! No, Samsung does not have “31 percent of industry revenue, compared with 15 percent for Apple.” Third parties [Strategy Analytics] claim that Samsung, which does not release unit sale figures, has 31% market (unit) share, not “revenue.” Apple dominates smartphone revenue and profit shares.

Rosenblatt continues, “‘Of course we’re pleased that the jury awarded Apple 6 percent of what they were asking for,’ Quinn said in the statement. ‘But even that can’t stand, because Apple kept out all the real world evidence and didn’t produce anything to substitute for it, so you have a verdict that’s unsupported by evidence -– and that’s just one of its problems.’ … Apple was awarded $930 million in the first trial. In that case, which involved earlier models of smartphones and tablets, Apple’s request for an order barring sales of infringing Samsung phones was rejected by Koh. Apple has said the ban was more important to it than monetary damages.”

    Right. And I’m sure they would be happy to entertain reducing damages to zero with a sales ban in place. A legitimate, no Samsung phones brought into the US, sales ban.

  2. In Samsung’s world view, copying isn’t immoral, it’s competitive. Nothing will change that. Copying others is in their corporate DNA.

    Money is not the issue… especially for their lawyers, who will happily continue to cash their checks.

  3. Too bad for Samsung. They are pissed. They must pay Apple more than 3 times what they argued in court was appropriate. But much more importantly, they are unhappy the legal case decision continues the unambiguous narrative that Samsung has willfully infringed Apple’s patents.

  4. Reading the San Jose Mercury this morning it appears Job’s comments about going all nuclear had impact on the jury. One thing they wondered about is why was Apple not suing Google because that seems to be who they are after. Job’s comments and emails seem to have impacted the jury quite a bit. Just like the book and employee snafus Jobs comments have come back to bite Apple in the butt. Please Apple, just make products, this legal shit is killing you.

    Is that really that difficult to see Samsung/Google have slavishly copied iPhone and iPad (anyone ever saw Steve Jobs’ keynotes and dare to distort this “reality”?); and that how hard is it to figure out Samsung/Google is still sneakily trying to infect the world with premature lab-version items as if they are truly innovative and user-centric consumer products?

    When those keep saying Steve Jobs is distorting the reality, I think they are so full of bullshit. Samsung/Google are indeed the master of reality distortion… Not Steve Jobs. Apple marketing also is not as good as Samsung/Google when you think deeply about what has been happening for all these years. Apple’s marketing is just fairly describing their great products. Samsung/Google make people think their shitty things are equally good or even more valuable than Apple… Who is distorting the reality?

    So uuuuuuupset to see all these keep on happening.
