Judge sets new trial dates in Apple v. Samsung patent battle

“A federal judge has set new trial dates in November to decide whether $450.5 million of damages awarded by a jury to Apple Inc in a patent dispute with Samsung Electronics should stand, according to a court filing,” Reuters reports.

“Judge Lucy Koh ordered on Monday that the new trial on damages should take place between Nov. 12 and 18,” Reuters reports. “Koh, rejecting Apple’s motion for an increase in the jury’s damages award, ordered a new trial on damages for 14 devices, which include Samsung’s Galaxy SII. The jury’s award to Apple for 14 other products, totaling almost $599 million, was maintained.”

Reuters reports, “The court also reinstated the jury award of $40.5 million relating to one Samsung phone, the Galaxy SII AT&T, which will not be included in the new trial on damages.”

  1. Samsung loosing everywhere else apart from this judges court.
    By November of this year virtually all the patents that Samsung hold dear aided by Android will have been deemed as having been invalid or in infringement of someone else’s patent not just out in the world by by American bodies as well. A few have been invalidated for Android which have a direct impact on Samsung’s claims. Will Apple inc. be allowed to present those findings in November without the need for a new trial starting from scratch? I guess only this judge will tell. Who overseas her judgments though?
