“When Judge Lucy Koh last month ordered a new trial to determine the proper damage award for 14 of the 28 Samsung devices found by a jury last summer to have infringed Apple (AAPL) patents, nearly every reporter covering story followed Reuters‘ lead: ‘Apple had a major setback in its ongoing mobile patents battle with Samsung Electronics on Friday, as a federal judge slashed a $1.05 billion jury award by more than 40 percent,'” Philip Elmer-DeWitt reports for Fortune.
“Almost lost in the flood of “Apple setback” headlines was the lone voice of FOSS Patent’s Florian Mueller, who pointed out that what was being described as a drastic cut in a $1.05 billion award could, in theory, turn out to be an increase,” P.E.D. reports. “One month later, his analysis has received a measure of vindication from, of all places, a late-Friday filing by Samsung’s lawyers: ‘Apple,’ they wrote, ‘can seek even more damages on these products in the new trial.'”

By the time all this resolves itself we’ll be looking at the iPhone 8. Samsung knows it just has to keep a couple of inches ahead of the glacial pace of legal proceedings, particularly with a judge who likes to push cases to 2014 and beyond. I bet U.S. troops will be withdrawn from Afghanistan well before this case is over.
Samsung is like the Silver Surfer, surfing just ahead of the legal wave knowing full well that any infringements of patents held by Apple will take so long to resolve and the monetary compensation reduced to such a negligible amount that it would be worth their while to infringe, copy and sell closely copied products, reaping billions upon billions of profit with clueless consumers who can’t tell the difference or Apple haters.
That billion+ penalty will end up being the best money Samsung ever spent.

If they hadn’t turned out to be such blatant natural born thieves to be shunned I suspect they would have all been Samsung models. It is somewhat conciliatory if some of Sums**t’s ill-gotten gains end up in Apple’s pocket instead. Looking forward to the Apple devices crooked Korean competition would find especially hard to copy.
