Since there doesn’t seem to be any patent for the Tab,
Apple should win automatically with its patent No. 0000181607-0001.

Because any child can decide for themselves as customers, that the 2 devices basically do the same thing and look very similar… Putting price as the definitive factor.

In summary, the Tab is definitely a COPY as it presents itself as an alternative.

The Galaxy Tab 10.1, Tab 8.9 and Tab 7.7 do not infringe Apple’s registered design No. 0000181607-0001 — which is an aesthetics only patent.

The question should be, “does Samsung have any patent for protecting its aesthetics?” And if not why? Because there is no point to file for patents on copied designs. The infringments go far beyond the look and shape but the entire packaage and how it functions.

Samsung purposely mimics Apple as much as possible in order to confuse distinctive differences as to whos’ products is whos’.

The blatant historical inaccuracies in various Hollywood movies designed to malign the English are clear examples, like those in Argo, Braveheart, and The Patriot, while U-571 blatantly made the whole Enigma machine capture an American success story, when it was British personnel who captured the machine from U-110 long before America even entered the war.
Just reading this site, I would maintain that American judges are far more corrupt, especially those in East Texas.

Stop whining about Samsung. It simply does what any good, responsible corporation does to respond to a serious threat of war – do what it takes to neutralize the threat by retaliating and inflicting as much pain and suffering on your enemy as possible. After all, it was Apple who waged thermal nuclear war on Google/Samsung.

Samsung won by working hard to find and exploit a legal loophole. That’s what you do when you are at war. Kudos and congrats to Samsung for being incredibly resourceful and clever in this case. Apple lost because it was outplayed and out-maneuvered, period.

Cook the George McClellan needs to do some soul searching and decides whether he has the will and guts to fight fire with fire. Was there a report that Cook was afraid of and against suing Samsung? If true, he should raise the white flag, issue an apology (his specialty), and stop wasting company time and money pursuing a war he will lose.

I concurred with Page when he jokingly and sarcastically said “What war?” in an interview. If thermal nuclear war means GOOG breaks new highs on a daily basis while AAPL does the opposite, then “What war?” indeed.

To those attacking the UK justice system (on which the US system is based) I’d point out that generally our system is regarded as one of the best in the world. Our journalism isn’t though! The retired judge is being called as an expert witness and contrary to this report is in no way being hired by Samsung.

BTW – the judge’s ruling was quite correct. Apple sued under a law to protect its registered design – a design which contained numerous details that Samsung simply did not copy. Can’t blame the judge for that. His ruling requiring Apple’s public statements was totally bizarre though and certainly smacked of bias.

Whatever. In any case and for whatever reason, in the war with Samsung, Samsung is winning. Going away winning. Apple is suffering from weak leadership. Extraordinarily weak leadership. The reason Samsung is winning is not just because they have good lawyers or that they are buying judges or stuff like that. No, Samsung is winning because they are out maneuvering Apple at every turn. Walk into any phone store, hang around for just ten minutes or so and you will see it. Until someone at Apple Inc. does something, this is only going to get worse. Until the owners of the company say enough already and find them a true leader to take the helm, it’s only going to get worse. iCal this.
