UK judge who ordered Apple ‘apology’ to Samsung and said Apple lacked integrity hired by Samsung

“The UK judge who ordered Apple to issue multiple statements saying that Samsung didn’t copy the design of the iPad has been hired on by Samsung to act as an expert in an ITC investigation,” Kevin Bostic reports for AppleInsider.

“The Rt. Hon. Professor Sir Robin Jacob has been brought on as one of nine ‘experts […] working on behalf of’ Samsung according to FOSS Patents,” Bostic reports. “Samsung’s counsel submitted the filing listing Jacob as an expert witness in court on Wednesday. ”

Bostic reports, “In November of last year, Jacob ruled that Apple had failed to properly comply with a court order that it should prominently display on its website that Samsung had not copied the design of Apple’s iPad… Speaking on Apple’s initial attempt at complying with the court order, Jacob’s opinion read: ‘I hope that the lack of integrity involved in this incident is entirely atypical of Apple.'”

FLorian Mueller writes for FOSS Patents, “For someone so concerned with “integrity” it is utterly unusual to issue a high-profile and extreme ruling in favor of a particular party (Samsung in this case) only to be hired as an expert by that same party in another dispute.”

“I’m sure that Samsung and Sir Robin Jacob wouldn’t be doing this if there was any risk of this conduct violating the law,” Mueller writes. “Apparently an ex-judge who is invited to rule on a case involving a given party is not barred by existing UK rules (though this case here may spark a debate whether some reform is needed) from being hired by the same party in another litigation outside the UK less than four months later.”

MacDailyNews Take: We’d like to think that we’ve now seen everything, but, sadly, we don’t believe that’s the case.

Previously, we called this one of the stupidest judgements in history. It’s looking like something even worse now.

Obviously, to anyone with even a passing acquaintance to integrity, this moron ex-judge should have refused any and all offers from the slavish copier Samsung. Any random seven year old would have enough sense. That this abject fool didn’t do so forcefully and forthrightly tells you all you need to know about his character or lack thereof.

There is nothing uglier than a man who lacks integrity.

  1. British judges are the most corrupt in the world. In fact on the scale of legal justice corruption, British judges are even more corrupt than the Taliban.

    At least you can’t buy the Taliban off with wads of cash whereas if you give a British judge a suitcase full of cash, odds are you’ll get the judgement you’re looking for.

    And this guy sits at the apex of corruption. 1 million Korean Won must have felt good passing through his greasy palms.

I would say that you’re an ignorant, stupid American, showing yet again how you like to portray English people in a bad light, in order to feel better about yourselves. The blatant historical inaccuracies in various Hollywood movies designed to malign the English are clear examples, like those in Argo, Braveheart, and The Patriot, while U-571 blatantly made the whole Enigma machine capture an American success story, when it was British personnel who captured the machine from U-110 long before America even entered the war.
      Just reading this site, I would maintain that American judges are far more corrupt, especially those in East Texas.

      The Galaxy Tab 10.1, Tab 8.9 and Tab 7.7 do not infringe Apple’s registered design No. 0000181607-0001 — which is an aesthetics only patent.

      The question should be, “does Samsung have any patent for protecting its aesthetics?” And if not why? Because there is no point to file for patents on copied designs. The infringments go far beyond the look and shape but the entire packaage and how it functions.

      Samsung purposely mimics Apple as much as possible in order to confuse distinctive differences as to whos’ products is whos’.

        Because any child can decide for themselves as customers, that the 2 devices basically do the same thing and look very similar… Putting price as the definitive factor.

        In summary, the Tab is definitely a COPY as it presents itself as an alternative.

  3. Well, I was going to take my family to London this year, but I have reconsidered. Bravo to MDN for seeing this as a sad statement on the Judge’s integrity. He has none. And we all understand Samsung.

    1. Seriously? You change your family’s vacation because one ex-judge does something that appears unethical but not unlawful? If this guy owned a restaurant I could see Apple fans not wanting to eat there, but to boycott an entire country?? And presumably disappoint your family into the bargain?       BTW – the judge’s ruling was quite correct. Apple sued under a law to protect its registered design – a design which contained numerous details that Samsung simply did not copy. Can’t blame the judge for that. His ruling requiring Apple’s public statements was totally bizarre though and certainly smacked of bias.

  4. Whatever. In any case and for whatever reason, in the war with Samsung, Samsung is winning. Going away winning. Apple is suffering from weak leadership. Extraordinarily weak leadership. The reason Samsung is winning is not just because they have good lawyers or that they are buying judges or stuff like that. No, Samsung is winning because they are out maneuvering Apple at every turn. Walk into any phone store, hang around for just ten minutes or so and you will see it. Until someone at Apple Inc. does something, this is only going to get worse. Until the owners of the company say enough already and find them a true leader to take the helm, it’s only going to get worse. iCal this.

  5. FWIW, as an employee of the City of Cambridge, MA, USA, if I did such a thing (i.e. accept a job at a company previously involved with my civil duties), this is clearly against the ethics rules of both the City and the State. I’d be arrested and fined, if not jailed. So, WTF!?

  7. The Judge, obviously, an avid Windows PC user and all his entertainment devices are branded Samsung. Which would explain his lack of attention to detail and his openness to accept thief in design.

  8. Prima facie evidence of illegal influence. The judge belongs in jail, or how about hung, drawn, and quartered in the old English tradition. If I had to bet on this I would sadly predict he will get away with this clear case of corruption.

  9. To those attacking the UK justice system (on which the US system is based) I’d point out that generally our system is regarded as one of the best in the world. Our journalism isn’t though! The retired judge is being called as an expert witness and contrary to this report is in no way being hired by Samsung.

    The judge who gave a verdict that was in favour of Samsung, a verdict that was widely considered as unusual and unduly harsh, is then 4 months later ‘hired’ by Samsumg?

    Hired? As in, giving services in exchange for cash?

    Sounds like payment in kind to me.

  12. Stop whining about Samsung. It simply does what any good, responsible corporation does to respond to a serious threat of war – do what it takes to neutralize the threat by retaliating and inflicting as much pain and suffering on your enemy as possible. After all, it was Apple who waged thermal nuclear war on Google/Samsung.

    Samsung won by working hard to find and exploit a legal loophole. That’s what you do when you are at war. Kudos and congrats to Samsung for being incredibly resourceful and clever in this case. Apple lost because it was outplayed and out-maneuvered, period.

    Cook the George McClellan needs to do some soul searching and decides whether he has the will and guts to fight fire with fire. Was there a report that Cook was afraid of and against suing Samsung? If true, he should raise the white flag, issue an apology (his specialty), and stop wasting company time and money pursuing a war he will lose.

    I concurred with Page when he jokingly and sarcastically said “What war?” in an interview. If thermal nuclear war means GOOG breaks new highs on a daily basis while AAPL does the opposite, then “What war?” indeed.

    Hmmm. “Sir Robin has been contracted as an expert by a law firm that represents Samsung Electronics in its case against Ericsson.”

    He is being paid by a law firm paid by Samsung. I don’t know how _you_ follow the money, but as far as I can see, it’s a pretty straight line.

    1. Maybe, but at least we don’t bomb, blow up and kill our allies, as have US Forces been proven to do repeatedly, nor as was witnessed in WW2 take aim, shoot and kill the locals of North Africa (after Operation Torch) simply for target practice/fun.
