“The UK judge who ordered Apple to issue multiple statements saying that Samsung didn’t copy the design of the iPad has been hired on by Samsung to act as an expert in an ITC investigation,” Kevin Bostic reports for AppleInsider.
“The Rt. Hon. Professor Sir Robin Jacob has been brought on as one of nine ‘experts […] working on behalf of’ Samsung according to FOSS Patents,” Bostic reports. “Samsung’s counsel submitted the filing listing Jacob as an expert witness in court on Wednesday. ”
Bostic reports, “In November of last year, Jacob ruled that Apple had failed to properly comply with a court order that it should prominently display on its website that Samsung had not copied the design of Apple’s iPad… Speaking on Apple’s initial attempt at complying with the court order, Jacob’s opinion read: ‘I hope that the lack of integrity involved in this incident is entirely atypical of Apple.'”

FLorian Mueller writes for FOSS Patents, “For someone so concerned with “integrity” it is utterly unusual to issue a high-profile and extreme ruling in favor of a particular party (Samsung in this case) only to be hired as an expert by that same party in another dispute.”
“I’m sure that Samsung and Sir Robin Jacob wouldn’t be doing this if there was any risk of this conduct violating the law,” Mueller writes. “Apparently an ex-judge who is invited to rule on a case involving a given party is not barred by existing UK rules (though this case here may spark a debate whether some reform is needed) from being hired by the same party in another litigation outside the UK less than four months later.”

Previously, we called this one of the stupidest judgements in history. It’s looking like something even worse now.
Obviously, to anyone with even a passing acquaintance to integrity, this moron ex-judge should have refused any and all offers from the slavish copier Samsung. Any random seven year old would have enough sense. That this abject fool didn’t do so forcefully and forthrightly tells you all you need to know about his character or lack thereof.

British judges are the most corrupt in the world. In fact on the scale of legal justice corruption, British judges are even more corrupt than the Taliban.
At least you can’t buy the Taliban off with wads of cash whereas if you give a British judge a suitcase full of cash, odds are you’ll get the judgement you’re looking for.

The Galaxy Tab 10.1, Tab 8.9 and Tab 7.7 do not infringe Apple’s registered design No. 0000181607-0001 — which is an aesthetics only patent.
The question should be, “does Samsung have any patent for protecting its aesthetics?” And if not why? Because there is no point to file for patents on copied designs. The infringments go far beyond the look and shape but the entire packaage and how it functions.
Samsung purposely mimics Apple as much as possible in order to confuse distinctive differences as to whos’ products is whos’.

BTW – the judge’s ruling was quite correct. Apple sued under a law to protect its registered design – a design which contained numerous details that Samsung simply did not copy. Can’t blame the judge for that. His ruling requiring Apple’s public statements was totally bizarre though and certainly smacked of bias.
Don’t judge a country by the actions of a single judge. That is truly an overreaction. The U.S. has plenty of corrupt judges, as does every other country (some worse than others).

FWIW, as an employee of the City of Cambridge, MA, USA, if I did such a thing (i.e. accept a job at a company previously involved with my civil duties), this is clearly against the ethics rules of both the City and the State. I’d be arrested and fined, if not jailed. So, WTF!?

Prima facie evidence of illegal influence. The judge belongs in jail, or how about hung, drawn, and quartered in the old English tradition. If I had to bet on this I would sadly predict he will get away with this clear case of corruption.

Talk about people who live in glass houses throwing stones! This judge has serious integrity issues and ethical challenges. Sure looks as if the fix was in when this case came before him.
So let me get this straight.
The judge who gave a verdict that was in favour of Samsung, a verdict that was widely considered as unusual and unduly harsh, is then 4 months later ‘hired’ by Samsumg?

Stop whining about Samsung. It simply does what any good, responsible corporation does to respond to a serious threat of war – do what it takes to neutralize the threat by retaliating and inflicting as much pain and suffering on your enemy as possible. After all, it was Apple who waged thermal nuclear war on Google/Samsung.
Samsung won by working hard to find and exploit a legal loophole. That’s what you do when you are at war. Kudos and congrats to Samsung for being incredibly resourceful and clever in this case. Apple lost because it was outplayed and out-maneuvered, period.
Cook the George McClellan needs to do some soul searching and decides whether he has the will and guts to fight fire with fire. Was there a report that Cook was afraid of and against suing Samsung? If true, he should raise the white flag, issue an apology (his specialty), and stop wasting company time and money pursuing a war he will lose.
