“Apple Inc. Thursday won an injunction against Google Inc.’s Motorola unit over infringement of Apple’s ‘rubber band’ patent, in a ruling which bans the sale of Motorola products in Germany that infringe the patent,” Ursula Quass reports for MarketWatch.
MacDailyNews Note: She means “rubber-banding,” also called bounce-back scrolling.
“The court, in the southern German city of Munich, didn’t specify how much Motorola will have to pay Apple in damages, or which products will be affected by the judgment.,” Quass reports.

Simon Sage reports for Android Central, “The win will likely mean a sales injunction as soon as Apple posts its 25 million euro bond, and for an extra 10 million euros, it can get Motorola to destroy the infringing devices. For another 10 million euros beyond that, Apple can force Motorola to announce a recall.”
“Motorola has been contesting the validity of this patent, ‘List Scrolling and Document Translation, Scaling, and Rotation on a Touch-screen display,’ through the entire case, though Apple has defended it successfully so far and will do so one more time in Mannheim Regional Court on December 7 before all is said and done,” Sage reports. “Has Google’s investment in Motorola as a patent bulwark proven to be effective or is it more of a liability?”

It’s a bond. If the injunction gets overturned, apple loses whatever cash the judge determines is fair to the injured party. (that sounds like I actually know what I’m talking about!)

When Google bought Motorola, they thought they have a shield to defend themselves against infringing Apple’s IPs. But Motorola proved to be a poisoned chalice. It caused a big hole in Google’s pocket. Google could have utilized Motorola to made its own phone but instead it turned to the serial copycat Samsung to do the job. Samsung recently got itself in big trouble and this is a harbinger of big trouble to the Android ecosystem.
Motorola is a shadow of its former self, holding patents that has proven useless to Google because most of them are being pledged essential. Google is not helping the unemployment problem in the US by sending many Motorola’s employees into the welfare system. Google got to wise up and get rid of Motorola. And to follow up with this step, Google must abandon Android. Google has not made money out of Android. Android itself is an infringing product. Instead of helping America Google is helping overseas raiders like Samsung to weaken American competition. Android has not contributed to innovation at all. Instead of making its own rectangle distinctive, it sets to copy the rectangle of the iPhone and the iPad.
