If you look at the profile of the mountains in Apples photo compared to the one in the HTC photo, it is IDENTICAL…. but I would say it is not the same photo (that Misrach shot). Of course there is nothing illegal about going out and taking another photo at the same angle, but the fact that they did this is enough to make me throw up.
