“Samsung Electronics Co.’s chief executive officer will talk with his counterpart at Apple Inc. to see whether they can resolve their smartphone patent dispute before a U.S. jury begins deliberating, according to a person familiar with the matter,” Jun Yang and Joel Rosenblatt report for Bloomberg.
“The companies’ lawyers will report to U.S. District Judge Lucy Koh in federal court in San Jose, California, on the outcome of today’s telephone discussion between Apple’s Tim Cook and Samsung’s Kwon Oh Hyun, according to the person, who asked not to be identified because the talks are private,” Yang and Rosenblatt report. “Samsung is seeking as much as $399 million in royalties from Apple for infringing its patents, according to court testimony. Apple presented testimony that Samsung owed it $2.5 billion to $2.75 billion in damages.”
Yang and Rosenblatt report, “Deliberations could begin as soon as tomorrow, the judge has said.”

Stole what? Apple long offered to license the Samsung’s FRAND 3G patents for a reasonable fee, but apparently FRAND translates to extortion in Korean.
Apple used the technology covered by Samsung patents. But Samsung pledged to offer these patented technologies to ANYONE who pays FRAND licensing fees. Apple has stated on the record that they are 100% willing to pay these fees.
As soon as the rate is set, Samsung will get every penny of these FRAND fees from Apple, retroactively back to the beginning.
The only issue is that Samsung refused to accept a rate that was consistent with FRAND terms. Samsung wants exorbitant rates from Apple, completely out of line with what others have been charged. Other companies have (for some patents) paid only a tiny fraction of what Samsung demanded from Apple. And for some of the patents (like the emoticon text entry patent), companies have been using the technologies at no charge from Samsung.
