Samsung files eight more patent infringement claims against Apple

“There’s further escalation between Apple and Samsung,” Florian Mueller reports for FOSS Patents.

“In February, Apple brought a new U.S. federal lawsuit against Samsung, the second of its kind in the Northern District of California. Late on Wednesday by local time, Samsung brought its answer to the complaint as well as infringement counterclaims over eight patents,” Mueller reports. “Two of those patents are FRAND-pledged patents that Samsung declared essential to ETSI standards. Five of the patents (including the two FRAND patents) were originally applied for by Samsung, while three others were acquired (one from Hitachi, one from a group of three inventors). Also, Samsung’s complaint states for two of the patents that Apple was shown ‘detailed explanation[s]’ of infringement (presumably that means claim charts) in October 2010. One of those two patents was previously asserted against Apple but then withdrawn from the first California litigation between these companies.”

Mueller reports, “So far, none of Samsung’s infringement claims against Apple has succeeded anywhere on Earth, despite efforts in nine different countries, but Samsung keeps on fighting.”

    1. I think the judge should take FRAND agreements that companies attempt to use against other companies and make them public domain, free to use as punishment for trying. That’d stop a lot of this nonsense PDQ.

      A classic symptom of the guilty. and a classic example is when a spouse constantly accuses their significant other of cheating on them… to the extent of borderline paranoia… and then it’s later realized that the spouse that was doing all the accusing was also doing all the cheating.

        1. Thanks. It’s just the first thing that came to mind, and it just makes total sense.

          Headlines will read “apple was hit with x more lawsuits” which does take some attention away from Samsung…

          Of course, this will work two ways. Remember the person who does all the wailing and *eventually* gets caught cheating…

          And I cannot wait for that day to come. Samsung will be dealt with swiftly and decisively.

  1. So, is this how Samsung responds to Judge Lucy’s order for the two DEOs to sit down and iron things out? If I were Judge Lucy I’d certainly if Samsung’s attorneys even heard her order, let alone understood it? What part of “Sit down and negotiate a settlement” didn’t they understand?

    Maybe they thought the order was for Samsung to file another lawsuit THEN sit down and talk since Samsung has put more ammo on the table.

    The mind absolutely boggles at whatever twisted logic Samsung is using.

    That’s because Samsung merely concoct fraudulent counter claims a lame retribution for being caught stealing. If you find this to be juvenile behavior, you are correct!
