“Apple Inc and Samsung Electronics Co Ltd agreed that their chief executives would participate in settlement talks to try to resolve a patent lawsuit over smartphone and tablet technology, according to a court filing,” Dan Levine reports for Reuters.
“In a court filing late on Monday, both companies agreed to the settlement conference. U.S. District Judge Lucy Koh on Tuesday then referred the companies to a San Francisco-based magistrate judge who will lead the talks,” Levine reports. “Along with Apple chief executive Tim Cook and Samsung CEO Choi Gee-sung, both companies’ general counsels will also participate, according to Koh’s order.”
Levine reports, “The case in U.S. District Court, Northern District of California is Apple Inc v. Samsung Electronics Co Ltd et al, 11-1846.”

Florian Mueller reports for FOSS Patents, “Within 90 days, they will make another effort to settle their dispute. They will meet in a San Francisco courthouse for settlement talks that will be overseen by U.S. Magistrate Judge Joseph C. Spero.”
“This settlement effort is only semi-voluntary. Judge Lucy Koh, the federal judge presiding over the two Apple v. Samsung lawsuits in the Northern District of California, ordered the parties to comment on their availability for an Alternative Dispute Resolution (ADR) effort,” Mueller reports. “In this situation, they both had to be cooperative: if only one of them had made the CEO available, the other one would have appeared to be less than constructive.”
Mueller reports, “A similar effort took place between Oracle and Google last fall (and again a few weeks ago) — but now they’re battling it out at a trial that started yesterday. The courts can obligate parties to meet and talk, but they can’t force them to settle. ”

Spero is a VERY tech savvy judge. This bodes well for a tough but common sense settlement.
The American justice system is a joke.
If you have just robbed a bank, you can use the money you just stole from the bank to post bail to get out of jail.
The American justice system has its problems. But I don’t believe that you can use stolen assets (evidence) to fund your bail. Try again.

No. Apple is in the right here. Samsung are deceitful sleaze. Why should Apple have to put up with fighting a rabid, mangy dog. Apple should simply be handed a syringe to put the creature out of our misery.
WHERE is the competition with Apple? Samedung is just another cloner with nothing of their own to offer. That’s not competition.
I know i just want to see Cook go at it with a Korean.
