ITC declines to review Apple-Kodak patent decision

“In a ruling late Monday, the U.S. International Trade Commission’s six-judge panel affirmed a preliminary decision in May that Kodak’s technology doesn’t infringe on Apple’s patent rights and that one of the two patents in dispute is invalid,” Ben Dobbin reports for The Associated Press.

“The commission’s chief administrative law judge, Paul Luckern, had ruled in January that the iPhone and the BlackBerry do not violate Kodak’s patent. On appeal, the commission asked Luckern in late June to take another look,” Dobbin reports. “Yet Kodak’s failure to score an outright victory heightened worries on Wall Street about whether the maker of cameras, film and printers will be able to cross back quickly enough into a reliably profitable company.”

“Mining its rich array of inventions has become indispensable in Kodak’s push to reverse four years of losses and return to profitability in 2012,” Dobbin reports. “After failed negotiations, Kodak filed a complaint with the commission in January 2010 against Apple, of Cupertino, Calif., and RIM, of Waterloo, Canada. It also filed two lawsuits against Apple in U.S. District Court in Rochester, but it has not specified the damages it is seeking. Both lawsuits are still pending. In a counterclaim three months later, Apple argued that some Kodak still and video camera products violate two of Apple’s patents.”

    1. Wrong. Earning great success is what stirs the lawsuit waters, and every rat wants to carve off a chunk of big cheese for themselves. Apple’s increased legal activity puts the vermin that have on notice they can’t feed off what the company has worked so hard to create. The Kodak case was one where Apple was pushed on a tenuous issue and pushed back. The end result was not as important as the fact Apple is willing to go to battle to protect themselves.

    2. Well, now that Apple doesn’t innovate to compete and is JAPT (Just Another Patent Troll), it will be Apple filing all the lawsuits. I’m glad Eric Schmidt clarified that up for us.

    good, kodak has been the bain of photographers. Karma is a bitch. Kodak is my opinion is as bad to photography world as Edison was to electricity. Thank goodness he had Tesla to put out business before Tesla could give the world free energy.

    Karma is a bitch and it is coming to all the greedy corporations faster than a biblical plague… (as I watch News Corp defend breaking so many federal and international laws). Hopefully the FCC will realize it would be unethical to grant News Corp a U.S. License.

    1. why is this a big blow to apple lawyers? if you know much about patent law, both offensive and defense, what is the basis for the post as epic fail?
      “epic fail” seems kind of like the “jus’ sayin’ thing so many “wanna be cool” guys/ladies throw out. i don’t claim to be a cool guy but among my buds there are a couple of ” oh so wanna be’s” who constantly throw that out while everybody else looks the other way or the rudest one just snickers.

      You do realize Kodak is facing bankruptcy at the rate their stock is falling. Apple could buy Kodak, their patent library with the change in their pockets.

      Kodak is DCW….and just because Apple tried to countersue and lost just means Apple MIGHT be giving Kodak some school lunch money. Not enough to convince investors tho.

      1. Kodak’s stock price has nothing to do with filing for bankruptcy. It still has a wealth of other patents to live off of while it builds a printer and digital camera business. I think Kodak should produce easy and great quality photo scanners and services for people to have photos restored and scanned to digital but retaining photo image quality.

Earning your wages by working for a living haha i’m gonna make me riches by suing apple for patent infringement, or misleading advertisements.. or ill operate an apple product improperly and sue for injuries sustained be it physical or mental.. or if any of those fail, then ill just lurk around an apple store wearing a hoody sweater and baggy pants and wait till i get kicked out and sue for discrimination! haha i’ll soon live the american dream – sue because i got nothing better to do in life.! watch.. learn… sue!
