“Last week I reported on Apple’s staunch opposition to Samsung’s request for early access to product samples of (and packaging and marketing materials related to) the next generation of the iPad and the iPhone,” Florian Mueller reports for FOSS Patents.
“On Friday, there was a court hearing to discuss Samsung’s request, but Judge Lucy Koh did not rule from the bench,” Mueller reports. “On the eve of the hearing, Apple had amended its complaint.”
Mueller reports, “Yesterday (Tuesday, June 21, 2011) the judge entered her decision on Samsung’s iPhone 5/iPad 3 request: The good news for Apple is that Samsung’s motion is denied at least for the time being. This comes as little surprise… The potentially bad news for Apple is that the court order contains a passage hinting that Apple may not get a preliminary injunction against the sale of certain Samsung products in the United States at this stage.”

This will make loads of previous patent laws questionable.
If Samsung comes out with a product later that us almost identical to IPhone 5 or IPad 3 , they cant be faulted anymore.
It will create a lot grey areas and lawyer will laugh all the way to the bank , while these 2 giants fight !!

Judging from all the gushing here, wonder if anybody actually read the original article. Apple had some not so great news in the judge’s decree as well.
Earlier, Mr. Mueller had suggested that Apple’s legal team had delivered a masterpiece of an argument and addendum; I guess, I’m content then legal Apple is now better capable, and doing all it can which hopefully will be good enough.
Cant blame Samsung… they learned it from Scheisters like Bill Gates and Eric Schmit how to steal and scheister yourself into billions.
