Apple quietly settles with patent troll, promptly gets hit by new one

Apple Store“Ah, the good ol’ patent minefield,” Robin Wauters reports for TechCrunch. “According to Law360, a paywall-shielded newswire for lawyers, Apple yesterday settled a patent infringement lawsuit with patent troll Minerva Industries, whose website is apparently currently, ahem, ‘temporarily closed under repair.'”

“Last Tuesday, Apple and Minerva filed a joint motion to dismiss all claims and counterclaims, stipulating that each party would bear its own costs and attorneys’ fees. On Wednesday, Magistrate Judge Charles Everingham of the U.S. District Court for the Eastern District of Texas promptly dismissed the infringement lawsuit with prejudice after receiving the alert,” Wauters reports. “Minerva Industries had earlier settled lawsuits with HP, Research In Motion, Sony Ericsson, Motorola, Nokia, Alltel, Boost Mobile, Qwest Wireless, Sprint Nextel and Verizon Communications. As I said earlier, there’s a patent troll at work here.

Wauters reports, “This morning, Apple was hit with another patent infringement suit, brought on by Israeli technology holding Emblaze, which alleges the Cupertino company has refused to license its media streaming technology at issue.”

  3. I get tire of people getting a patent for an idea (VAPORWARE) that will be evolved into some day so some lawyer can show up with a patent infringement suit.

    I assume that there are patents on AI (artificial intelligence) by idiots that have know idea how to make it happen. Who is handing out these patents like it is toilet paper? If they can show you how it works they can patent it. If not, go away!!!

  6. ron, I’m not 100% certain, but I think that’s what Anim8me2 was saying. Without being QUITE so pointed about it … quite so rude.
    There is a time and a place for comments like the opening salvo in this dispute. I don’t feel TMac got it right. Not even CLOSE! This was a randomly-placed troll with no redeeming value or linkage. That you don’t recognize this fact impugns your intelligence – or your values? – and the fact that you defend what is, essentially, indefensible, places you in the same court with the offender.
    The laws, such as they are, are long standing, beyond the previous Democratic Administration or the FIRST Bush Administration, and cannot be held against the current (or previous) Administration. Alternate claims are totally bogus, as are the claimants.

    Embaze isn’t vaporware. It’s failedware. I worked with them in the late 90s. Even back then they were pitching their technology as being a breakthrough in many ways that I found questionable.

    They actually had some products that were cool at the time, but they were Java based which resulted in a lot of processor overhead as well as not having a sufficient codec to produce quality video over the standard bandwidth available at the time.

    Still, it was cool that it was cross-platform audio, video, and animation at a time when many tools were Windows only.

    I really don’t see though how the concept itself for live streaming over HTTP could be patented. If a protocol is published like HTTP and someone takes advantage of the published specs, it doesn’t make sense that they could then patent that.

  12. Rules are rules. If anybody infringes of apple’s patents, the fanboy trolls are up in arms, but if apple do it…it’s just a bunch of insignificant whiners…

    You can’t have it both ways. Sure it’s not good, and it makes the bloodsucking parasites that are lawyers wealthier, but its the nature of the beast…enjoy!

    There are several posts in this thread that should be censored per your policies. Most, of course, come from unregistered trolls. But theloniousMac is registered user and a habitual political commentator fomenting discord on unrelated topics. I suggest that you politely and firmly invite him/her to try frequenting websites from Limbaugh, Hannity, etc. at which he will be greeted with open arms.
