But that almost makes it worse, because they did pay $5000 for something that they HOPED was stolen property, and they turned out to be correct.  If I were Denton, I would leave that out of my next tweet.]]></description>

The are not trying to investigate a journalists source but find out who did what in a case of theft. The value of this phone as a prototype will be more $5000 as it will be a custom made small production run. Gawker can&#039;t plead innocence especially as they were previously offering cash for hands on with the iPad before launch, this heads into industrial espionage territory.&lt;br /&gt;

		<description><![CDATA[To answer an earlier question, apparently the guy in possession of the phone didn&#039;t think to turn it over to a bar employee, and the bar&#039;s owner noted that the Apple employee who lost it was frantic calling in with inquires as to whether or not his phone had been found at the bar.  Simply turning it in to the bar would have solved everything.&lt;br /&gt;

I&#039;m also wondering if the guy receiving the $5000 is going to report it as income.&lt;br /&gt;

This case has had people citing the law that makes property stolen even if lost, if a just effort to return it to the rightful owner isn&#039;t made, along with the finder using the item for personal enrichment. I am absolutely, 100% sure this is a publicity stunt. Just look at what&#039;s going on with this. Of all the times Steve has generated tons and tons of incalculable free exposure for his gadgets, this is the biggest winner of them all.&lt;br /&gt;

He might not have known exactly how it would play out, but he&#039;s behind it ALL - the grand master of the baton controlling the every movement of his vast orchestra.&lt;br /&gt;

Both of these seem to have somewhat plausible excuses for their actions. The &#039;finder&#039; found the device on a bar stool and allegedly thought it belonged to his friend (he was also somewhat drunk at the time, allegedly). He took it and gave it to this friend. His friend took the device, a bit later looked at it closely and realised it wasn&#039;t his. A bit closer look revealed that it wasn&#039;t an ordinary iPhone, which made him curious. Remember, by now, the original &#039;finder&#039; was gone. So, this friend starts poking around the phone, discovers the owner&#039;s name (via Facebook app), makes a half-assed attempt at contacting Apple to return it, then goes to sleep. In the morning, the phone is already bricked. He is now sober and begins to figure out this is a very new device. He now thinks of Gizmodo. So, believing that he satisfied the (moral and legal) requirement to make a &#039;reasonable effort to return found property&#039;, he thinks of an idea to make his friends at Gizmodo happy.&lt;br /&gt;
&lt;br /&gt;
The original finder may have a slim, but possibly plausible (if corroborated) excuse for not returning the phone to the bar owner. Being (allegedly) drunk, he thought he returned it to its rightful owner and his story ends right there. However, this &#039;friend&#039; who received it and proceeded to sell it has much less solid legal ground to stand on.&lt;br /&gt;
&lt;br /&gt;
As for Gizmodo, their legal ground is pretty much quicksand.]]></description>

		<description><![CDATA[Let me start of by saying that I am all for the 1st Amendment and the Freedom of Speech.  As a senior editor of a small Apple News site (AppleScoop.com), I totally agree with what law enforcement has done.  &lt;br /&gt;
&lt;br /&gt;
Gizmodo.com, in its blindness to be &quot;the first&quot; to get their hands on a non public prototype device, committed a crime by &lt;br /&gt;
&lt;br /&gt;
1) Purchasing a STOLEN device.&lt;br /&gt;
2) Publishing a report on a NON PUBLIC prototype device.&lt;br /&gt;
&lt;br /&gt;
I also feel that the editor(s) should be treated as criminals, have a criminal record, and be put in jail for no less then 3 months AND the web site shut down during that time as well.&lt;br /&gt;
&lt;br /&gt;
Reporting on RUMORS and speculation is one thing, but when someone commits a crime to get their hands on a prototype device AND publish a full page report about it HAS to be dealt with swiftly and quickly.]]></description>

As long as they are informing the general public and not just their grandmother. (I don&#039;t think of my kids as journalists)&lt;br /&gt;

That gun you mentioned would certainly be searchable while the computer(s) used for reporting would not be. &lt;br /&gt;
The offer to buy stated &quot;no questions asked&quot;, which is hardly a protection for Gizmodo but good for the seller. And that offer could be found on the site without any legal paperwork at all. The offer, the following through, would seem to be sufficient proof of intent.]]></description>
