AT&T and Verizon dismiss lawsuits over 3G coverage

“Atlanta-based AT&T Mobility and Verizon have agreed to dismiss a lawsuit over Verizon ads,” Jeffry Scott reports for The Atlanta Journal-Constitution.

“AT&T claimed the ads mislead the public about AT&T’s coverage,” Scott reports.

Stacey Higginbotham reports for GigaOM, “The carriers also dismissed an earlier lawsuit originally filed by Verizon against AT&T about which holds the title of America’s most reliable network, and AT&T’s countersuit on the matter.”

“Perhaps the network operators were inspired by the upcoming holidays, or they’re simply saving their lawyers for a barrage of lawsuits after the FCC finishes with its net neutrality rules, special access regulations or any number of other topics the agency is investigating,” Higginbotham proffers.

“ATT is running scared. Those executives saw the new holiday versions of the ‘maps’ theme and started pissing in their pants. They fear Verizon smells blood and might keep the ads fresh on the air all year round (which, if they’re smart, will be exactly what they do).

By the time ATT could come up with a counter campaign, the damage has already been done. Plus it probably wouldn’t be nearly as clever as the Verizon ads. So you do the next best thing: run to the courts with sweat dripping from your brow.”

“This case will get thrown out on its ass. The whole affair will only serve to further embarrass ATT, as if the highly successful ad campaign targeting their fledgling 3G network wasn’t painful enough already.”

The Luke Wilson advertisements are the most misleading and insulting advertisements I’ve ever seen! They tout this ‘coverage’ but it is obviously their calling availability, not their 3G coverage area.
As a prospective iPhone owner, I am insulted that they would think that they could put that over the American public…

With that sort of misleading (actually with the intent of basically lying to their customers/prospective customers), how can they be trusted in other areas?… sad… what greed will drive a corporation to do.

Please Apple, give us a choice, a real choice (although Verizon seems like it will charge us an arm and a leg for every little thing).

AT&T;marketing and corporate communications, what an impotent mess. The company has allowed their reputation to crash without any effective effort to manage it. Some of their bad rep is deserved, but their inability to communicate their good story is embarrassing. Verizon’s attack is dishonest but very effective and feeds into an already negative image.

Instead of cry-baby lawsuits, or running murky overly-busy ads, how about showing Verizon’s version of the maps, then countering side-by-side with an accurate one, then show the maps comparing high-speed 3G (Verizon’s blank), then tell us they are building out the network of the future.

For the sake of accuracy, no, R2, that wasn’t “prescient”. The suits never made it to trial. They were DROPPED. By the two companies (no judge involved). Voluntarily. No case law cited, no present laws applied. Both parties reserved the right to sue again if they wished. So, it was either victory for AT&T, as well as for Verizon, or a defeat for both AT&T and Verizon, depending how you look at it.

One thing is certain, the likelihood of Verizon getting an iPhone can only diminish from advertising campaign such as this.

As for Luke Wilson, it appears that AT&T is now hitting on their own with the “talk and surf” theme more directly. And it’s hitting home, judging by the fuming of the likes of R2.

Verzion is really the one running scared.

1. They have a tapped out system that is dead to invest in and building out a new one. Not yet used and is the same as ATT-GSM.
2. They have no hit phone to pull in the high end users to any quanity.
3. ATT is building out the GSM system and money is pouring in from the high end smart phone user to aid the upgrade.
4. ATT has the need now to focus on the network and the upgrade investment incentive to continue to expand and speed up the system.
5. Verzion has to lean on their current system for at least a couple of years before the new one really has any foot print.
6. The GSM covers less area and will require new towers and increased spotty areas as they transfer and add cost to upgrade where possible.
7. If Apple goes to TMobile, that will add in the loss to Verzion as users will also leave or have increased new customers counts to TMobile as it slims down the possible new adds to Verzion.
8. They have to act now as more choices makes it even harder for them to get new and higher paying customers.
9. Blackberry is less of a draw now, Palm is not better at drawing customers, and android is still fleshing out.

10. THEY SO SCREWED THEMSELVES! It hurts having to work so hard at getting customers when they would have just walked right into the office if they had the iPhone. Dumb!
