Software Developer files suit against Apple over use of ‘Rendezvous’ name

“Developer Tibco Software has filed suit against Apple for alleged trademark infringement,” reports Jonny Evans for MacWorld UK. “The litigant claims to own the rights to the Rendezvous trademark, and has filed legal papers in California’s District Court alleging that Apple: ‘Carried out acts infringing on Tibco’s trademarks, with the intention to trade on Tibco’s goodwill and harm Tibco’s business.'”

“The company seeks remedies for the ‘competitive and economic harm caused by Apple’s acts,’ it said,” Evans reports. “The company describes itself as a: ‘Leading developer of software that enables real-time business by creating interoperability between diverse computer systems.’ The company has been using its Rendezvous trademark since 1994 and its Tibco Rendezvous mark since 2000. It has put ‘considerable effort’ into marketing those brands, it said.”

  1. Oh, and all this time I was just sure that Apple had teamed up with Tibco to put Renedezvous into OS X, what with all that ‘considerable effort’ they put into marketing.

  2. TIBCO Rendezvous is a messaging system targeted at enterprise customers. Apple’s Rendezvous isn’t even a stand-alone product. Ironically, this suit will probably win them more recognition than any of the “considerable effort” they have made to market their brands.

  3. Let’s see here Rendezvous has been out how long? It took them how long to file suit? hmm… i think someone is just looking for some money or something if you ask me….

  4. Actually, Apple got burned by the original holders of the iTools name, iTools became .Mac and Tenon’s iTools has retained the original name and have succes in selling this product os OS X. Apple will change Rendezvous’ name, rest assured. Let’s not McZealot ourselves and defend Apple in their mistakes; better yet, let’s come up with a better name, after all, Rendezvous is French (rendez-vous, actually, which means “meeting”) so what will it be?

  5. Hey you know, maybe Apple made a mistake. Maybe they’ll have to change the name. Maybe Tibco have a genuine case. Is that so far fetched ?

    I can’t believe how partisan some of you can be. Take the blinkers off.

  6. No, no, no. That’s take the *blinders* off. Turn your blinkers on.

    Tibco’s assertion is that Apple is trying to “trade on their good name.” My assertion is that I (and many others) had never heard the name “Tibco Rendezvous”, despite all of their claimed marketing effort, until I read this article. Tibco stands to gain more from litigating on Apple’s good name than Apple could possibly have gained from trading on Tibco’s good name.

  7. I remember Rendezvous back when it was competeing with Lotus Notes in the business workplace. To be frank, it _was_ hot sh*t. I had assumed that Apple had bought the trademark… interesting to see that was not the case.

    Apple should have known better when naming products.

    Also, Tibco were mentioned today in my workplace regarding some protocol converter device, so it’s not like it’s a completely different field. If I mention Rendezvous at work, I doubt that anyone would be able to associate it with Apple so it’s not like they’ve got more right to it than Tibco.
